My logic here is that if both Judges are just Chupp Lazy, they would fob it off to the third then lazily follow his lead.

My unrealistic optimistic prediction is everything comes back, because it would be funny.

My realistic optimistic prediction is all defendants come back, but not on all causes of action (e.g. TI for Marchi). Funny because even if Vic ultimately loses at summary judgment or jury trial, the defendants get buttfucked by their own lawyers while B&H and MH dive into swimming pools of weebbux.

My realistic pessimistic prediction is MoRon and Funimation back on one or two causes, and Marchi skips.

My unrealistic pessimistic prediction is Vic goes 0/34.

My Lemoine prediction is Vic goes 0/34 and owes the defendants $500k.
 
I'm not sold on Jamie, seems a stretch at this point, but if there's a just and loving God, he gets Ron / Monica / Funimation at least on enough to drag them into discovery, at which point they find enough to go after Sabat (and Jamie, if she escapes).

Ultimately though if they can just get them back then Vic wins the PR war for the upcoming months, at the very least. "A senior court found that Vic's case had merit, he provided enough evidence that Jamie Marchi, Monica Rial, Funimation, and Ron Toye conspired to illegally defame him and blackmail conventions into blacklisting him to take it to trial. Sony and Sony's counsel had no comment at this time."

And it'll immediately put a financial burden upon the defendants that I don't think they can overcome. With Time's Up collapsing thanks to them covering up Joe Biden's sexual assault of that one woman (turns out the hair on the head isn't the only hair he likes to sniff) I don't think Jamie will be getting any help from them, for example. Ron's career is dead thanks to some idiot Chinese guy eating a bat, Monica is probably gonna be blacklisted from Funimation the second they can...

Well for any claims brought back. they're on the hook for those fees themselves. So financial burden is going to sting like mad! Especially for MoRon.

I'm willing to believe most if not all causes, including on Marchi, at least make it past TCPA. As long as Marchi makes it past TCPA, I don't actually care that much if she gets dragged much further. She can come back later, if necessary. I just want to make sure all the defendants have to pay their own legal bills. Also, because the concept of TCPA is to get rid of lawsuits so frivolous that the plaintiff should be punished excessively just for trying to bring it to the court in the first place...there really should be more than enough evidence to scoot by even on weaker causes.

I suppose it depends on what you mean by "pessimistic". I don't expect every single one of the causes of action to go through following the appeal. I don't expect all of them to be dismissed either. I think the outcome will overall be in Vic's favor, but not to the degree a lot of people here might be hoping for.

Of course, I've never really been all that emotionally invested in the lawsuit. And, if I'm being honest? If you are seriously emotionally invested in this lawsuit, and you're expecting every single thing to go through, Chupp to be verbally castrated by the CoA and Lemione to be mocked ruthlessly...you're gonna be disappointed. Which isn't to say I wouldn't love to see it happen; that would be hilarious to see. It's just not a very realistic outcome.

I figure everyone here is more or less like gamblers on a boxing match. We don't have any stake in what is going on but we like to look at the odds. We also oddly ask for reasons when someone gives us extremely pessimistic views.

You remember what the response was like on here when the TCPA ruling first came out? I might not have an emotional stake in it, and you might not either, but the ones who do will pop up when the CoA's ruling comes out.

It's not that unreasonable. The court could think that the case against them all is weak, but that the TCPA hearing was not the proper venue for the conclusions that were reached. Keep in mind part of what made the case "weak" was the defendants refused to comply with discovery and then the TCPA stayed it. The appeals court could decide to send it all back and tell Chupp to let discovery go ahead and if it's still weak after that THEN he can start dismissing things at a summary judgement hearing.

And I will laugh at them. I want to see a blow against cancel culture because it's fucking terrible and the sooner more people stand up and win the better, but the wailing and endless salt from weebs is a silver lining if it doesn't happen.
