I know I'm extremely late, but this scenario makes me wonder something.

Say a woman becomes pregnant, births a child, and then the husband transitions. The woman, for once, gets a divorce.

Typically, the courts side with the mother. What would likely happen here when there's a biological mother and a not-so-biological mother?

The mother will still get preference because she actually grew and expelled that child from her body.
