Even Melinda is backing off from it, saying he had every right to be all up in his wife's phone and shame in her for trying to use it to call for help when he became violent. Which Marshall had no choice but to do because she had been verbally and emotionally abusive to him.
The horror. Even if his ex wife were abusing drugs, which there is no proof of, I guess Marshall lacked the presence of mind to come up with an alternative plan for remedy besides smashing a phone, violently assaulting his spouse, then tearing a landline cord out to prevent her calling for help. Maybe he could have used his words. Maybe, since we are led to believe that his ex wife was a drug addict and horribly abusive for years on end, he could have walked away before there was ever a child. Even after, if she was a drug abuser, easy to prove in family court, boom, custody to dad.
But what am I saying. This is real world logic. Not Melinda's excuses. I'm honestly kinda with @Deadpool. Just settle in for a nice glass of Drano @TamarYaelBatYah. You will clear one of humanity's clogs.

I'm not an expert in marriage related benefits, but if two people are legally married then in almost every state it doesn't matter if you live together physically or not-- there's still an implied mixing of the finances that would affect any benefits received (except for medicaid, I guess?)

Personally, I'm guessing they keep the second property for tax fraud or to avoid debt collectors.
