The claims are completely frivolous and not valid, I'm pretty sure if they go through with a lawsuit they'd have a pretty decent chance of winning, as once its out, its out, reporting on "classified" government information is protected no matter how you got it, just unless you're the one that obtained it in a obvious way.

I had an entire thread on subverting expectations awhile ago, but it boils down to, you have to give something back. You can't just take away something, and give your audience nothing of what they want. Kojima understands this. Which is why he didn't have Raiden beating Solid Snake to death. You can take away Solid Snake, but you have to balance that with something fun and engaging your audience wants. Working with Snake was giving him back, in a way. You didn't play as him, but he was a major character and had a big role in the story. Kojima understands this. Even with MGS V not playing as Big Boss, but as his double. Some people were upset, I wasn't. I knew what he was trying to say. This was his last MGS game and you were all the Boss. It was to show his appreciation and love of his loyal fans as a final farwell. How can you get pissed over that? Plus Quiet, I love how he fucked with people who whined over that..

People who do this, believe that simply taking something away is enough. It isn't. Joel and Ellie dying in a car crash and you playing some rando isn't subverting expectations, its fucking idiotic. That's what this is equivalent of. You have given nothing back to your audience, so why should they like you for that?

If he didn't want to deal with their story, he could have moved on. Their was a hook, yes. But you could choose not to use it.
