Apollo Legend confirms Billy Mitchell will have a class action lawsuit brought against him.

He's so confident that a group of people collectively suing Billy Mitchell for defamation won't cost more than the $10,000 he was quoted that he's planning on giving the excess money away. $50 to a random person every day until it's gone.

Yeah, unless the guy is working on some sort of contingency payment, I don't see it remaining that cheap.
 
I don't think he loses SLAPP on the dispute over whether he cheated, even though I personally think it's obvious he did. He still says he didn't and it's the kind of thing that takes expert testimony to prove. Where I see him having an issue is proving damages. It generally isn't defamatory per se to say someone cheated at a video game. Here he could argue it is because it's his profession so it's defaming him because it is saying he is incompetent at his profession. I think it's questionable whether some ancient video game records count as such, though, and without it being considered defamatory per se, it will be hard to prove damages.
I wonder if where he's suing has that clause about truth being a perfect defense against defamation.

Ostensibly, it was to prove Wiebe wasn't using a legit PCB in his cabinet. There are claims that the film took dramatic license and that they actually had permission to investigate the machine, but those come from Billy and his friends, so...yeah.

The King of Kong movie is pretty worth watching, regardless of whether you care about the record itself, but it does have a pretty obvious slant. @Jean Lafitte 1812 posted this Summoning Salt video about the record that goes into the record disputes a bit more, and he also talks about the specific runs that were the subject of the dispute that led to Billy's scores being removed from TG. Salt did the video a few years ago, however, so he only casually mentions the oddities surrounding the runs. But it does also kinda demonstrate that TG was historically very...favorable toward Billy during Walter Day's time, which is a pretty sharp contrast from how it treated him under Jace Hall.

I'd say Walter Day was favorable toward him pretty much since 1982, long before he had any financial stake in the company. But yeah, the fact that he was literally a part owner of TG at various points was obviously not helpful. I'm not actually sure if he was financially involved at the time of the Boomers score (I think Day and Mitchell had sold the company in 2009 and the record was 2010, but records aren't super clear), but I think he was during the other two (the KoK and Mortgage Brokers scores).
 
Walter Day himself always seemed like he was envious of people who could perform well at arcade games in a very enthusiastic fanboy way which is probably what secured him the gig, so he's not as suspect as the rest of TG when it comes to dealing with Billy but in consideration to the rest of the crew I wouldn't put it past them that between Billy being somewhat legendary to them and him being their bankroll that they were a lot more casual about how they handled exceptions with Billy. I'll be honest I didn't really pay attention to Billy much outside of the KoK documentary and a bit of the fallout between him and TG with exception of him getting assmad about the Regular Show goof on his KoK persona.

If you are in the position of having to prove truth you have already lost the SLAPP motion.

Also truth is a complete defense against defamation anywhere in the U.S. It's called the First Amendment. The government can't punish you for telling the truth (outside of a few cases like invasion of privacy like Hulk Hogan or non-disclosure agreements where you have agreed to keep something private or violating national security when you are a member of the armed forces). It's always a defense against defamation, though.

One thing going for Billy is that the guy whose documentary you get if you donate more than $10 to the GoFundMe has recently said some things that make him sound like a crazy person.
















He also accused Billy's competitor in the King of Kong of cheating too. He said that Steve Wiebe used MAME to change the code on his Donkey Kong arcade boards.

As mentioned earlier, Mitchell sells hot sauce. He sells it under the name Rickey's World Famous Louisiana Hot Sauce. I wonder if this will harm or help his sales in the short term and also longer term. When you look at general reviews, the first thing that stands out is that many reviews are from video game websites. After that the common user review starts with "I bought it as a joke and..." before describing the quality of the sauce. This could give his sales a short term jolt as people buy the sauce as a joke, though I can't imagine he'll sell that many more than normal. On the other hand when this case implodes around him, I expect the hot sauce empire to take a hit.

I would also want to know how good/bad his hot sauce is, I'm a fan of hot sauce. But fuck this guy, I'm not giving him a penny.
It isn't terrible. One of my hobbies is collecting and trying obscure hot sauces. You could call me somewhat of a connoisseur.

I rate sauces on flavor, heat, and lip to palate burn ratio. A perfect sauce will have excellent flavor, heat matching what is advertised on the bottle, and equal parts lip and palate burn.

Billy Mitchell's sauce I score as follows, with 3 being average.

Flavor: 2/5, far too vinegary and salty. The vinegar and salt really drowns out the other flavors. You can tell the sauce is made with cheap extracts and not fresh ingredients. It is bearable but just barely.

Heat: 3/5, it is pretty much what I expect when I open up some mediocre hot sauce. The amount of heat is acceptable, although it could be hotter, and it dissipates pretty quickly.

Burn: 2/5, the burn is very forward on the lips, and dissipates almost entirely as it reaches the palate. I think this might have to do with the sauce being pretty thin.

Overall it isn't a very good sauce, and is outmatched by even off the shelf cheapo brands like Chalula. In my humble opinion there isn't any reason to buy this hot sauce over any established brand of similar price point, unless of course you're just a huge fan of Billy Mitchell.

Edit: I am specifically referring to the Ricky's World Famous Louisiana Hot Sauce, the original, that is.

I'm not sure it's a straight up lolsuit on either side but I'm increasingly suspicious of the prudence of either side's choices to go forward with this bullshit.

Yeah, I was posting the Apollo video more as an update rather than an endorsement of it. Personally, I think it's a waste of money. Only the one guy, Dwayne Richard, even has potential for a case, and it's still almost definitely not making it to trial.
