Billy is probably suing Apollo because he's still assblasted about the time Apollo called him out while cosplaying as himself

There's a speedrunning community about beating games as fast as possible and in some ways it's similar. In fact, there was someone who did score runs at one of the most recent GDQ events beating an arcade game and it stood out.

The difference here is that community cracks down harder on splicers from the get go.
Yeah, speedrunning is a massive thing. It's really fascinating how some people can just utterly break games in half all for the sake of a faster time.
Now GDQ, on the other hand...that's a fuckin treasure trove of lolcows. The amount of insane troons lurking in those conventions is staggering.
This pic should say it all lmao

Good OP. Was waiting for this to be brought up outside of the relatively Twin Galaxies thread.

I've attached the retraction letter Billy Mitchell sent to Twin Galaxies and Guinness Book of World Records prior to the lawsuit, his 156-page "Evidence Package", his amended complaint against Twin Galaxies, and their motion to dismiss.

View attachment 1284343

So there is a lawfirm behind him, one that looks like it's going to cost Billy at least $700+ per hour. This might get entertaining

Nothing says fun lolcow like an overly sensitive, litigious, self-righteous loser to the real world like Billy Mitchell. I'm surprised he's even trying to do damage control anymore after he's had his ass handed to him so many times since King of Kong released, but here we are.

EDIT: Oh shit, the dumbfuck is doing this pro se

What does he actually hope to accomplish here?
What he always does, intimidate people into silence. This guy is a complete meme at this point, a disgraced legend of classic gaming bullying and trying to silence critics.
When I heard the figure, I thought he called on a certain Dogbite lawyer in New York, turns out he's doing it on his own. All bark and no bite, and likely to be countersued.

Earlier in this thread there was a link to Apollo Legend's gofundme to countersue. He already busted his target.

Can't wait for all the anti-slapps to be in and Billy to retract his lawsuit before he's forced to pay everyone else's lawyer fees (and maybe even some punitive damages so that he stops brandishing the court like a cudgel).

The two guys who would have fought against everyone protecting their high score was Billy Mitchell, and "Mr Activision" or Todd Rogers as it was the both the thing that made them famous and made them money.

First it was Rogers to get outed as a blatant liar and cheater, and his defense was basically saying, "Bruh, my hands aren't warmed up. Cmon man".

Then it was Mitchell who threw hissy fits whenever anyone criticized him or made a parody of him. Example: Dude got super pissed at Regular Show (A show about a raccoon and a blue jay on Cartoon Network) when they made a parody of Mitchell who cried over his high score and literally had a big head.

Interesting his Regular Show caricature is mysteriously absent from wiki

From what I've seen he seems like Taylor Swift constantly playing the victim. He also seems to garner a lot of hatred and negativity from other gamers and the like.

He lives in Florida lol how shocking.

Interestingly, a large part of the speedrunning community actually came from Twin Galaxies back in the day. However, TG had requirements that wound up being antithetical to what the speedrunning community wanted: they didn't permit any intentional glitching of games; they considered it cheating. So they wound up going to other communities like Speed Demos Archive and obviously, it grew quite a bit since then.

TG's a weird relic, and I doubt the world would lose all too much if they stopped existing, but this is one of the lamest defamation suits I've ever seen someone of this profile file in a court of law.

In case anyone is curious, Billy's Donkey Kong score was invalidated because there was evidence that he made the high score using an emulator, instead of the actual arcade hardware which he claimed it was on. The reason this matters is because even if Billy actually legitimately played the game on an emulator, it wouldn't be exactly the same as the arcade, there could be slight differences that someone playing on the arcade hardware wouldn't have. But it would also be a metric shit ton easier to cheat on an emulator.

Now this is coming from memory so I could be wrong about some details but the overall story will be the same. Billy was already a well known figure at the time of the Donkey Kong record, he submitted his scores to Twin Galaxies on a VHS tape. At the time, I believe, you needed to have somebody from Twin Galaxies there in person at the time of the record to confirm it's legitimacy, but since Billy was already well known they just took his word for it.

Years later some tubro autist analyzed the footage from Billy's tape. And when going through the footage frame by frame they noticed something odd. When the actual authentic arcade hardware generates a Donkey Kong level, it does so in a very particular way. Emulators at the time did not 100% replicate this process, and when going frame by frame it's obvious which platform the footage came from.

Lo and behold, Billy's footage generated levels exactly like the emulator MAME would. Billy swore up and down this was false. A lot of drama happened but at the end of it all Billy could not explain away the dependency, and his scores were officially invalidated.

TL;DR - Billy submitted a high score for the arcade version of Donkey Kong. Irrefutable evidence appeared that showed Billy actually achieved the high score on an emulator. Emulator scores are kept separate because there is no way to prove you didn't cheat in some way.

Doesn't he realize that this will just legally prove that he cheated? Is he fucking delusional?
Technically it wouldn't anymore than Vic Mignogna's case being thrown out means he is legally a rapist. That's assuming it's thrown out at the Anti-SLAPP stage, which means Billy couldn't show evidence he had a cause to sue. If this goes forward than he gets to make his case and Twin Galaxies/everyone else gets to make their case and then at that point if Billy loses then yes, he's legally a cheater.

Even if the tapes were actually edited to make Billy look bad, Apollo would not be liable for that. Billy would have to either sue whoever supposedly edited the tapes, or he would need to prove that Apollo had knowledge that they're edited prior to posting a video with them included as clips.

Time to read up on Florida anti-SLAPP.

One thing seems interesting

768.295(4) said:
(4) A person or entity sued by a governmental entity or another person in violation of this section has a right to an expeditious resolution of a claim that the suit is in violation of this section. A person or entity may move the court for an order dismissing the action or granting final judgment in favor of that person or entity. The person or entity may file a motion for summary judgment, together with supplemental affidavits, seeking a determination that the claimant’s or governmental entity’s lawsuit has been brought in violation of this section. The claimant or governmental entity shall thereafter file a response and any supplemental affidavits. As soon as practicable, the court shall set a hearing on the motion, which shall be held at the earliest possible time after the filing of the claimant’s or governmental entity’s response. The court may award, subject to the limitations in s. 768.28, the party sued by a governmental entity actual damages arising from a governmental entity’s violation of this section. The court shall award the prevailing party reasonable attorney fees and costs incurred in connection with a claim that an action was filed in violation of this section.

The language is odd here. The last sentence implies that the winner in an anti-SLAPP, defendant or plaintiff, is awarded attorney fees. But the sentence preceding implies that only happens if the government sues you. But the sentences preceding that seem to roll government and "other entity" into one. So I don't know, if Billy prevails in a motion to dismiss, that he would be awarded fees.

And archive because habits.

Here's the Apollo Legend video that shows the difference between the arcade and MAME versions synced up with Billy's world record footage. Skip to 2:20 if you just want to see the comparison:
It's really unmistakable and uncontestable, which is why it's so astounding and (twin) galaxy brained that Billy didn't just cop to it. It's like the dude got caught with a big purple dildo hanging out of his fly but he's swearing up and down that it's his true and honest penis.

he used that notoriety to start a restaurant business and sell hot sauce and he's worried that negative press is going to hurt his bottom line, it's all economics for him

His lolsuit is probably going to cause him more harm than even getting caught cheating.

It's like the dude got caught with a big purple dildo hanging out of his fly but he's swearing up and down that it's his true and honest penis.

More like the giant purple dildo was extracted from his ass by a surgical team but he's still denying knowing how it got there.
