Chump was an unpredictable factor. My experience of lawyers tells me that Ty is not outside the bounds of average, but Chupp is well outside the bounds of expected behaviour for a judge. You could have had the perfect lawyer with the prefect filings, and he still would have chupped everything, because he's an arrogant shit.

Get some perspective. Ty's fuck-ups (e: and they are supreme fuck-ups) don't exceed the norms, and in normal circumstances would not have even registered on the court.
I was doom and gloom when the TCPA first happened, but after being calm and looking, back, Chupp seemed to me a lot Ty's tendencies along with shit happening because no plan survives contact with the enemy.

I really think one of Rons "Pals" or even Lemon Fuher himself flagged Ron's tweets after the "Ronversations" to shut him up then Ron found he could try and spin then came here which everyone has said "He is insane for".
In Ron's mind, he is never wrong nor can do any wrong, he is his own worst enemy and Chuups fuck up gave them extra time but let us not forget Chupps famous words to Lemon Fuher about "Do you expect your clients to pay this full amount?" That is why Ron is trying to spin things,He isnt in control no matter what his pals or he tells himself.

No settling. Settling lets those weasily fucks get out of discovery. The reason he's begging for Vic to drop the lawsuit is they're out of money and the defense's legal teams no longer are financially capable of taking on a charity case.

Maybe, but if they lose appeal how do you know they'll get to do discovery? Most of these gate suits never even get past discovery.

If it gets past appeals, the only thing that will stop discovery is settlement.

And, hopefully if there is a pre-discovery settlement, I hope Vic makes them grovel with public apologies, because he deserves that and it would be hilarious.

At this point...maybe vic should settle? Ty done a horrible job the first time and I have very little hopes of the appeal working. Ty fumbled so hard that I doubt han lee can fix this, texas is just California lite and the tcpa is unbreakable, justice doesn't really exist. I'll eat my words if the appeals is 17-7 or completely obliterated moron, funi and marchi, but I'm kinda have gaymergate/culture war fatigue and I don't want vic to lose again.
There WAS a possibility to settle, but the defendants wasted it, remember? At the beginning and when Chupp had them all discuss (I can't remember what it was called) the whole thing before he gave his ruling? The defendants don't want to admit what they did was wrong and hurt Vic's career (as well as interfering with conventions), and continue to act like he's the scum of the universe. They don't want to actually settle, they just want Vic to try to settle for a "gotcha" moment.

Also, why blame it all on Ty? You know Chupp fucked up when he turned a prima facie into a trial. Maybe Ty should have had all the papers on hand, but I'm not too sure it would have mattered in the end.

You have to remember, at the time Chupp ordered the mediation, he had thrown out all but three causes of action, and had completely dismissed Marchi. They were basically holding Vic by the short and curlies at this point. They had the leverage, not him.

Isn't that what Vic wanted in the first place, along with retractions?
Probably. Personally, I'd also want a hundred thousand from each defendant for my troubles, but I'd bet money that if Vic was offered a complete retraction, admission of guilt, and apology (probably in video format) he'd immediately drop the suit and not even ask for any money. Everyone would pay their own lawyers and that would be that.
 
I have to agree with @WhimsicalTrolli . Not about Vic settling, but about feeling pessimistic about the outcome of the court case.

It's kinda sad that the overall consensus on the court case here went from: "Vic will legally destroy them all!!", to: "Well, he can still win on appeals!!", to: "Well, maybe Monica and Ron can be brought back on one or two causes of action, but Funimation and Jamie are most likely out of the case..." I used to believe Vic could get fully exonerated by the legal system and start working at dubbing studios again, but that's in the past. Now I only hope he won't have to pay all the fees for the rest of his life, on top of not getting a whole lot of con invites and jobs anymore. Now I'm honestly just hoping Vic will get to live the the remainder of his life in peace.

I don't blame one person or event for this failure of a court case, btw, I think it's a lot of factors coming together.

And, as many have already pointed out, Vic settling now would be very stupid. Almost as stupid as apologizing for things he didn't do.

It is natural that you feel fatigued because you, like many others I'm afraid, broke the gladiator arena rule: You're supposed to enjoy the spectacle and masturbate to the bloodshed and not climb down to the blood soaked sand get yourself involved. I understand that Vic is a sympathetic guy that didn't deserve any of this shit, but please do understand that getting emotionally involved in this is just as pantsu and head retarded as getting emotionally involved in Internet Bloodsports. There is a silver lining though: No matter if Vic wins or loses, we will have plenty of Julay for almost a lifetime. Be it people here or Funimation and its associated voice acting lolcows, you can't tell me that you wouldn't appreciate to see the majestic view of the Endless Pink Fields of /biz/ once more.

Don't worry about Ty, he'll win in the end, no matter if he wins the case or not. He'll be smoking his cigars and bang some hot bitches on his private yacht in Miami to the tune of "You" by Lloyd and Lil Wayne. How things will look for Vic, I don't know. I doubt he'll ever get new roles in the (American) anime dubbing scene. The damage to him has already been done and I don't see anything undoing it, whether he settles or even BTFOs the defendants in court. Maybe if Funimation gets sidelined by a competitor and depending if and how much the reputation of Harvey Weebstein and his Sacred Ointment Club is irreparably tarnished, but even then I dare not guarantee anything.
Look, if things go belly up, Nick has said he's got a lot of shit that if Vic goes down, the defendants go down with him. Just wait for fireworks.
Call it a gut feeling or woman's intuition on my part or whatever you want, but I have a hunch that Nick's dirt on Funimation will be akin to Ron's hundreds of women.
