I disagree with some of that but none of it really matters.

Whether Preston has a civil case or not here's what we know:
- The cops are investigating (allegedly)
- That could lead to a conviction (unlikely)
- That could lead to evidence required to mount a civil suit (likely)
- That could lead to exposure of other criminal acts like dildos mailed to WarCampaign enemies as threats (possibly)
- Any or all of this leading to an entertaining shit show I'll enjoy the fuck out of (definitely)

Cops won't investigate a claim someone exposed a person's porn past.

It couldn't lead to charges. District attorneys will unfairly target poor people but usually avoid unfairly screwing over people who can hire good attorneys.

Public figures have their embarrassing pasts be exposed very often. They can't sue if it's true and if no laws were broken or no rights violated to find and release that truth. Not possible for Preston to sue for damages when he was damaged by videos he made pubic.

I see pretty much one way Preston gets anything he wants, and that's if he files a suit, no matter how spurious, against Ethan, and makes a public apology and $0 dollars of compensation a settlement option. Ethan might make a milquetoast apology to make it go away for $0 dollars. I'm not holding my breath but that's Preston's best chance in my opinion.

Preston needs to remember that court filings generally can't be defamatory no matter what kind of shit you put in them, and require you to make the case to seal them, so if he does file suit Ethan gets to lay out his side of the story in a minimum of 1 filing he can't be sued over.

Ethan laying out his side of the story WILL REQUIRE talking about Preston getting his cheeks busted on video, repeatedly, and possibly will call for describing such things in somewhat more detail than strictly necessary for a filing, and there's nothing at all Preston can do about that.

If things get to discovery because Ethan likes pissing money like a firehose, it would be humorous to request the videos proving the busted status of the cheeks, especially since we're missing some of them. I don't see that happening unfortunately.

Frankly, Preston should be more concerned with how to get paid for the fact his cheeks were busted on video repeatedly, I'm sure there's some kind of monetization scheme pornhub can offer if he starts an account which costs him nothing he hasn't already lost and stands to make him something.

I believe that it's the sexual nature of the humiliation that makes it illegal and it's the perverted nature of the fetish/"sexual orientation" that might make it a "hate crime" which is horse shit.

Whether there is an actual prosecutable case there is up to a DA to decide but if the police are investigating and Preston gets access to the info unearthed in the investigation through FOIA or otherwise Ethan could be in a world of hurt.
