Here's why repealing 230 is a bad idea for the laymen on this forum.

The first thing is it'll intensify censorship, because now websites will have much less of a safe harbor for when shit hits the fan. The second thing is well, let's say Null actually shuts the site down Lavabit or CL personals style (can't run it under US law so and so, blah blah). So a disgruntled Kiwi decides to start their own offshoot forum with hookers and blow since the original is gone anyway.

It's now a lot harder to. The issues that plagued this site such as hosting problems and mad lolcows writing Cloudflare complaints are still there. Section 230 is supposed to legally protect you against a lot of problems websites can legally face from users and with that gone, you've got more than just a bunch of shitty webhosts and domain registrars to deal with. You could be in legal trouble when your site pisses off someone much easier, or if someone decides to advertise their school shooting there. That's just the tip of the iceberg but it makes hosting a site like this not legally feasible. Twitter on the other hand? They still have the ability to throw lawyers at the problem and make it go away or get pushed under the rug. Do you think a smaller site like this has big tech industry lawyers?

This needs to be approved by congress etc. Even the text of the Executive order is vague and not binding:

"The FTC shall consider taking action, as appropriate and consistent with applicable law,"

"shall consider" is not "will consider" or "must consider"

sure, the FTC considers taking action "as appropriate and consistent with the law" and I would hope so. They shouldn't take action appropriate and consistent with things they are making up.

He also writes "This order shall be implemented consistent with applicable law and subject to the availability of appropriations."

"Consistent with applicable law" means that the law stays the same. He can't repeal anything by himself.

Also note that he writes:

"Section 230 was not intended to allow a handful of companies to grow into titans controlling vital avenues for our national discourse under the guise of promoting open forums for debate, and then to provide those behemoths blanket immunity when they use their power to censor content and silence viewpoints that they dislike. When an interactive computer service provider removes or restricts access to content and its actions do not meet the criteria of subparagraph (c)(2)(A), it is engaged in editorial conduct"

followed by

"It is the policy of the United States that such a provider should properly lose the limited liability shield of subparagraph (c)(2)(A) and be exposed to liability like any traditional editor and publisher that is not an online provider."

This all under the blanket of

"as appropriate and consistent with the law"

when did this become "Section 230 of the Communications Decency Act is repealed and content publishers are now personally liable when defamatory opinions are published"????

The only thing he says is "When an interactive computer service provider removes or restricts access to content and its actions do not meet the criteria of subparagraph (c)(2)(A), it is engaged in editorial conduct"

which means when when a service provider *both* removes or restricts access to content *and* does not meet the criteria of subp. c.2.A it is engaged in editorial conduct.

Why does this mean "allowing defamatory opinions to be published results in personal civil liability"????

I can't speak for others, but for me it comes down to "Can I do anything about it?".

As someone not from the US, the answer is "no", so there's no point in me getting worked up about it because it's only going to be extra stress. I'm not going to stop others getting worked up about it if they care about it.

I've been hearing that something or other is going to be the end of civilization or the internet as we know it since before Brexit, and it's never happened. I've also seen lolcows throw huge tantrums over things and they achieve nothing but make themselves look foolish.


For those in the US, what do you propose they do? You keep saying "protest", but how? Shout at him on Twitter like every blue checkmark has for the last 4 years? That seems as effective as starting a change.org petition or telling people to write to their congressman.
