Nope, still looks like he has the second-degree manslaughter charge against him, which is a bit weird. How do you argue that someone intentionally killed someone else by complete accident?

He wouldn't be convicted of both, they'll shoot for a murder charge but failing that it doesn't exclude the possibility he's guilty of manslaughter. A jury will decide if he's guilty of murder, and if not they still might find him guilty of the lesser charge.

And manslaughter doesn't mean by killing someone by "complete accident", there has to be some kind of deliberate criminal intent. The person accused of it has to have known they were doing something that a sane person could reasonably assume might result in death, otherwise it would just be negligent homicide.

At least that's my understanding form other cases I've followed.
