Generally, but there's issues with airspace and local jurisdiction. The feds have national jurisdiction, but it's not unlimited, and I don't know how local surveillance laws interact with it. They're free to walk a public street and take pictures, of course, but airspace is sometimes private and sometimes restricted.

If they're flying a drone 30,000 feet up that probably gets around it, but I'm not an expert on this stuff.

If it's under 55 pounds and below 400 feet, the government can operate drones by line of sight. It gets more complicated above that. The FAA has a guide apparently.
