The best part of this shit show is how Marchis strip mall lawyer has basically showed all the other big boy lawyers up by writing competent briefs and not engaging in showboating.
I don't know about non showboating. Sam's filings do have a flair for the dramatic.

He's s just smart about it and let's MoRon do the heavy (and expensive) lifting.

They have flair, but it comes second. He is putting the strong arguments first, letting others do their thing, and then adding his flair once he has something solid.

I like Sam, he is the only competent -person- in this case.

Johnson may seem the most competent in this case because that's the one we've heard the least but he's probably as stupid as the others. Isn't he the guy who put an acrostic for Nick in one of his filings? I'd be more impressed if he paid no attention to people outside the case.

He was, but his arguments were good. Some extra flair after you have done your work is fine.

that was funny thought

He's paid the least amount of attention to people outside the case, I'd say. His filings haven't been loaded with shit about the GoFundMe or Nick Rekieta, he's not harping on about anonymous death threats sent to his client, and he hasn't gone out of his way to antagonize people who don't support his client. He's kept things straight and level relatively-speaking when compared to Lemoine. Then again, Volney's been pretty much on the same level, if not as well as Johnson has been. The acrostic, however, is pretty funny, and even Nick got a chuckle at it. he's been happy to let the bills rack up for MoRon because he knows he can also use any evidence they proffer, so it's less work on his part (work smarter, not harder) and keeps the billing to a minimum for his client, who he probably knows really can't afford this lawsuit, and is hoping the TCPA clears her completely. If not, he'll probably urge her to settle.

I've said it before but I will not be surprised if, win or lose, Ty contacts Sam for help on future cases, much like he did with Martinez-Hsu. Sam has been professional throughout, hasn't engaged in bullshit filings

Is there an ETA on when we all get to see what the appellate judges decide here?
Still have to wait for the inevitable request for extension from Lemoine, Johnson and Funimation at the last minute, unopposed; then another couple of months for the appeals court to pick it up, then to schedule oral argument.
And with CoronaChan going wild in Texas, there is no rush from the courts to put an at risk person like Lemoine in court.
I am backing late November.

The only one who can, at this point, request an extension is MoRon for the cross-appeal. The sur-reply is the last brief spelled out in the TRAP--think of it like a redirect at trial. if there's going to be a request for an extension I would expect that we'll get a notice of it relatively soon, as they have until next Thursday to file it. The worst thing for them to do would be to go past the deadline again. Since a sur-reply isn't necessary, though, and you can file a motion to extend the deadline after that date has passed along with your brief/reply, it won't tank them in the slightest, but it will still show the court one side is not taking it seriously and, as much as judges are people of law, they are also people with biases and opinions.

There's also the possibility that the appeals court rules just on these briefs already filed in Vic's favor because of the court record next week, but I'd say that one is so small a chance that it's barely perceptible. But that'd be fucking hilarious if they did.

People forget that Sam Johnson publicly hopped on the Nick Man Bad bandwagon after he won. He wanted no less than $50,000 in sanctions, in part, based on what a third-party had said about his client, whom he had never mentioned previously.

Lemoine at least talked about Nick and the GoFundMe before he asked for money.

He also is the only lawyer who hasn't screwed his client in one way or another, doing his job for a reasonable rate. As much as even Johnson's rate looks exorbitant when you think about it in terms of your own money, and would you pay this just for the privilege of shitposting on Twitter, look at the absolutely outrageous shit Lungmoine bills for absolute garbage results.

Why wouldn't he though? Of course he'd argue for sanctions. He's not in this shit for charity.

People endlessly giving praise to Johnson is just as pathetic as the asspats given to Ty initially. I don't see why people wash his balls so much for being competent.

And at the end of the day he's still a slimeball lawyer. The gif he had of Vic "pulling" Jaime's hair immediately comes to mind. He's good at his job but his job is to make money and defend his client whether it's true or not.

It's not sucking his dick to point out that he's been the only consistently competent lawyer in the whole case. If I ever had to hire a lawyer in Texas and for whatever reason only had these guys to choose from, Sam's the guy. Unless I were trying to sell an entire restaurant chain to Hormel and in that case Ty. Pretty sure that's never going to happen.
