Still, the Democrats reckon that if they can prove that America is a horribly systematically racist place where cops who murder innocent black people get let off they'll get the White House. Hence the overcharging.
I think there may be enough reasonable doubt that Chauvin's actions even caused Floyd's death. That's going to be a real problem for the prosecution. Maybe there are more detailed findings than the autopsy results we've seen but they have him at well over a lethal dose of fentanyl and that's not including everything else. If they aren't arrogant they'll also include some kind of aggravated assault charge for if they can't prove Floyd hadn't already OD'd fatally. But Ellison is arrogant. And I could see him fumbling the medical testimony badly.
I could see them trying to use Michael Baden's expert testimony to bolster what looks like pretty weak forensic evidence so far. I'm not sure about the logistics of using a family-hired mercenary medical expert retained to produce whatever they're going to use in the civil suit to contradict their own medical examiner but they'll probably have to try to do it.
There are all kinds of morbidly funny things about this, like them having to argue that despite him having all these drugs in him which would have killed a normal person, he was such a total druggie that this was just his normal day. I mean that argument looks great.
