In many things, yes, it's hard to tell if Phil is lying or being dumb. Here, though, given what we know, it's not hard at all.
We know he's concealing his gacha spending as a business expense. We know that he had to explain (or pigsplain, rather) that to Nancy. We know that his lawyer, at some point, told him to STFU about his case while on camera. We DON'T know if his lawyer saw through any of said pigsplaining, but regardless of whether or not she did, she doesn't want to get any further embroiled in Phil's bullshit, so being that specific about it is unlikely. Especially if she knows he's committing fraud. She wouldn't trust Phil if she did, better to just be vague in her instructions and if he fucks up like he did, she can walk away with her hands clean. Plenty of plausible deniability, regardless of what she actually knows, so long as he got specific, on his own, like an idiot, when she never was.
It's obvious to me: Phil said what he said because he's a stupid liar. He knows he shouldn't admit to playing WWE Champions, or claiming it as a business expense, but he doesn't know that admitting he had to deal with the meme interfering in his case constitutes admitting that Nancy had some real evidence of his gacha spending. He doesn't know that that theory of ours would be easily dismissed by Nancy if she didn't find anything backing it up. In his feeble mind, admitting to having to pigsplain some things is nothing incriminating at all. It's just an every day troll thing he has to deal with. He is the King of Suffering, after all, trolls can easily convince the public that he's a bad person without any evidence whatsoever.
As for the possibility of him setting her up to take the fall: he's stupid enough to think a scheme like that will work, but like I said, he's also stupid enough to not realize that we see confirmation of Champions in his bitching about having to deal with it behind the scenes. My money is on the latter, given that his fear of consequences tends to be stronger when it surfaces than his dimness usually is.
