Why did your lawyers bill something like 12 hours of deposition prep for you and Monica, when both you and Monica testified in your depositions that you had no deposition prep other than a short phone call?

To be fair, I already assume you to be a pathological liar and abuser, drunk on his own supposed power. I fully suspect that you only hired wick phillips because they're willing to spout the lies you speak. @Ron Toye - Did Wick Phillips tell you that the cases they cited in their appeals brief for fees said the opposite of what they were claiming they said in their arguments so that you would be emotionally and financially prepared for the appeals court to uphold the trial court's decision? Or did they also lie to you and tell you that McGibney totally says that defendants are guaranteed 100% of their fees in a TCPA unless the opposition submits a controverting affidavit?

In case you need a refresher, here's the part from McGibney that they cited:

To challenge the reasonableness of the amount charged for a service after a proper 18.001 affidavit has been filed, the opponent must file and serve a controverting affidavit in compliance with 18.001.

and here's the part immediately afterwards that says that even without a controverting affidavit, the trial court is required to review the billing to make sure it is reasonable and reduce fees if necessary:

However, while an unchallenged 18.001 affidavit provides legally sufficient evidence at trial to support a finding that the amount charged was reasonable, the affidavit does not constitute conclusive proof. In Atwood, the appellants contended that their uncontroverted 18.001 affidavits entitled them to recover the amounts reflected therein as a matter of law. But as we explained,

Section 18.001 affidavits do not establish that the [fees] were caused by the defendant's actions or that the plaintiffs are entitled to those [fees] as a matter of law.

Mr. Toye, we can go over this as many times as you'd like, but here's what Vic is saying here in plain English: "I don't remember quite how my time at my teaching gig ended, because it was 30 years ago. However, I would certainly remember being accused of sexual misconduct and/or being fired for it."

To pretend the meaning is anything beyond that is purely disinegenuous.

That second pic is way too casual for Monica to be wearing heels, and shes about the same height as the other pic, that would put Mr. Toye closer to the 5"7" height I guessed. Assuming of course she isn't wearing heels on either picture. Either way, he would still be shorter than "Vig Mangina who wears platforms!!!"

Cool, Since you have her height, I will post a photo next to her, so you can see, but as it is clear on the bottom photo, look at our shoulders, I am taller than her by 2-3 inches. Not that it matters, how tall a person is usually is only an issue for people who worry about that stuff. I won't argue about past correctness. It's moot as we're in appeals and they will decide if the judge acted correctly. However, my own research concluded he was right. well... to an extent. He did miss some other things that also make your lawyers citations not just bad but self-damaging. If I didn't know any better, then I'd say for some odd reason your lawyers are trying to make the appeals court bring everything back.

Also, I would like to point one flaw in your planning. If anything, even the fees come back, you give Vic a chance at a comeback. The moment its in Chupps jurisdiction, they can ask him to reconsider a prior position. And let me ask you, do you really think Chupp will be eager to give your side any chance at victory? I wouldn't place my bet on it.
