Ladies and gentlemen, appeals hearing is set for September 22nd. The panel will be Chief Justice Sudderth, plus Justices Womack and Wallach. There will be no oral arguments.

The case has been set for submission without oral argument on Tuesday, September 22, 2020, before a panel consisting of Chief Justice Sudderth, Justice Womack, and Justice Wallach.

Is no oral arguments good or bad?
I want to say it's better for Vic. Despite all the errors in Typo Beard's writing, he hammers the important points well, and I think the law is on Vic's side for most of the causes of action. I still think things like TI for Marchi is shaky at best.

At the TCPA hearing Lemoine was trying to bewilder and confuse Chupp with powerpoints of dumpster fires. Without oral arguments it's just on paper, and I think BHBH showed prima facie and fact questions in his filings well enough.

I just hope these writers understand how Internet drama works. And how to spot games like how the defendants kept going after Nick and sending coded messages to him in affidavits. And I remember the “Vic Locks” thing being disproven by a video. So as long as they aren’t like Chupp who just see it as some slap fight, and videos can that were discussed here can be transcribed, Vic May have a shot.

Jamie Marchi explaining that the so-called "Vic Locks" were installed after an aspiring voice actor known as "Johnny Otaku" had to be forcibly removed from Funimation isn't part of the record and won't be considered.

Vic specifically denied every affidavit in his unsworn declaration in the second amended petition. For TCPA, that counts as evidence enough to defeat each affidavit. Slatosch was also strong for establishing TI, at least for MoRon.

Why do you think all the defendants had hateboners for the 2AP?

TI for Marchi is unlikely unless the court accepts the conspiracy angle, which is a possibility. If that happens then Marchi's in for TI, but I think you can only really prove conspiracy between MoRon, with FUNimation making a distant third party,

For those of you who don't visit the front page, there's a bit of news about one of the early frontiers of this cluster; Pretty Ugly Little Liar, the drama forum whose members dug up, spread, and most likely outright fabricated accusations against Vic all the way back in February of '19, has been shuttered by its operator. Trying to go there right now will get you a Cloudflare error page. Before that, this message was posted last night.

This will probably have little bearing on the case at this point, but I thought it was interesting that "deep issue with [the forum's] culture that I can't fix" was cited as the reason for shuttering it.

EDIT: Y'all givin' me alarm clocks… I went through the last 36 hours or so of posts in this thread but didn't see it mentioned. Did I miss it?

How funny that another major source of "evidence" for the defendants is now long gone... I wonder what that will mean when it comes to appeals...? When the judges look at the links the defendants sited to find nothing... I wonder how that'll look for the defendants? It's certainly not going to help their case, that's for sure.
