Richard C. Kyanka v. Ashley K. Martin (2020) - Lowtax's second divorce

I'm positive Lowtax is doing things he hasn't talked about, like when Logan revealed he keeps sending Ashli nasty emails and Megan suddenly filing a restraining order back in the Spring

I'm actually fairly impressed to see the g.a.l. being active and doing things. The kids are getting value for Richard's money, assuming Dana Outlaw ever manages to gouge her pound of flesh out of Richard's filthy fat body.

IANAL but I'm guessing a continuance makes sense if you've just switched attorneys.

I'm finding myself interested by this filing from 8/24/2020 though:

What would a $10 bond be posted for? Is Dana Outlaw registering a Something Awful account?

Dana is known to be very active and to pick a side and take it. She picked "which ever side lowtax is not on". The protective order is just about discovery confidentiality. GAL in motion re: not seeing his kids is alleging that lowtax didn't exercise parenting time for four months, dumped the kids off on his mom the first time he did, and got drunk on wine to live stream. Says that he has a tackle box full of pills he's perscribed and is known to drink and/or drive on them. She accuses him of selling Oxy's because he got a prescription and says hes allergic. Mentions arrest for hitting Logan.

Is that speculation or is there some hard evidence I missed?

If he has a prescription for oxys that he’s regularly filling - and that isn’t hard to prove for the GAL - the oxys are going somewhere.

So these are the possibilities:

- He's taking them, is under the influence of opiates when he parents but chooses to deny this to everyone and lies about his use of them (“allergies”);

- He’s selling them from the home in which he wants to keep children, which is a serious offence and also makes the childrens home a risky place full of inappropriate people;

- They are being stolen, which means they aren’t kept secured which is a massive risk to the kids as they could access them, ingest them and die;

- He’s providing them to someone else under force and duress, showing he lacks the ability to protect himself or the children.

All of these justify the removal of custody and a move to supervised contact only. Oxys that you can’t or won’t account for the whereabouts of are a pretty fatal addition to a contested custody case.

The records are public if anyone wants them, you send in this form to the Independence Office just tell them which documents you want off casenet. If you call I'm sure they will give you an email or fax number you can send it to. Fair warning - a copy of that form will get filed as a document in the case when you make the request.

I have MO casenet access, but I'm not willing to post the records because I don't want to take the liability for the redaction I'd have to make under state law.

No worries bro. I just thought that stuff might have been missed. Don't want no one putting themselves/their jobs in any sort of peril just for more chuckles at the trainwreck that is lowtax's life.

Looks the the schadenfreude levels should be set at "Complete fucking LOLacaust"

You are da true MVP

Fitting that the bane of Richard’s future would be a particularly vindictive Grandma.

Lol at the idea Lowtax is selling his precious pills or doing anything but snorting/eating them. He pays a lot for needless surgeries to keep those refills coming. He even pretended to do yoga for a few days! (because that was the best excuse he could come up with to get out of real of real PT sessions.)

If that damn doctor would just give him more oxys then maybe he could actually sit, do his live stream or not have to hit naggy bitches.

Im sure Ashli is done with his BS about the baby. He got upset being asked to watch the kid for an hour or two so she could sleep or take a shower when they lived together. But now she has to listen to him pretend he wants full custody in court. Ashli knew Lowtax was dumping the baby with grandma or sis to care for whenever he got visits. I bet she was thrilled that livestream finally proved to the court that he won’t deal with the kid solo for more than an hour while he petitions for custody.

It’s no surprise that Lowtax can’t and doesn’t want to care for a small child, but the fact his older children want nothing to do with him speaks the loudest. Usually a lazy dad who orders pizza and lets you do whatever you want because he’s high and playing video games is a popular choice for pre-teens. Lowtax must be a really angry dad with a temper to fuck up the “lazy weekend Dad who does not care what you do” gig. Ashli and Meghan double teaming him certainly sends a message to the court about his parenting abilities.

It's what I'd more or less concluded just from even the incomplete information we already had. She has to have a good reputation or she wouldn't be the kind of person who gets appointed as a special master.

It's from her own website but:

Dana Outlaw graduated from the University of Missouri-Columbia in 1999 with degrees in sociology and political science. Upon graduating from the University of Missouri-Kansas City School of Law in 2003, Dana immediately started her firm with an emphasis on family law. In addition to practicing law, Dana is an adjunct professor at the University of Missouri-Kansas City School of Law.

Dana Outlaw is a mediator and mediates cases involving child custody, property division, spousal maintenance and child support. She has served as a Special Master and conducted hearings on maintenance and child support. She is frequently appointed to represent children as their Guardian ad Litem in cases involving child abuse and neglect. She is the former contract attorney for Hope House, Inc., a domestic violence shelter, where she represented victims of domestic violence in orders of protection, divorce, child custody and child support matters. She is an experienced appellate attorney and has argued cases in front of the Missouri Court of Appeals Western District.

So she's a law professor, a mediator, an actual lawyer, and has even acted as a quasi-judicial officer, in addition to her current duties in these cases as a guardian ad litem. She almost certainly knows every judge in the area and has worked with them extensively. She's insanely overqualified for what she's doing in this case. And the recent volley of motions and other papers indicates she's going to take a very active role in the proceedings and this is going to be very adverse to LowT's interests.

If he doesn't wise the fuck up and put down the pill bottle and get his shit together, he's getting his shit pushed in, hard.

Kenny Garrett is a lazy retard and is likely to sign any order Dana puts in front of him if it's about the kid. She's definitely gonna get paid too, btw. That's usually 6-10k if something goes to trial, split, between the parties.

The judge on the modification is more likely to make her own decisions, but she's a hard ass and had a rep as a bit of a man hater.

So essentially, Dana Outlaw is the de facto judge in the Garrett case. Garrett is just going to sign off on whatever she concludes. If he really is a retard, this is actually a good thing in this case, because she already has LowT's number. And because it will be based on a factual determination, Outlaw will nail it down with findings of fact that will make it well nigh unappealable.

In your opinion, is that a reasonable projection of likely future events?

Also re the fee split, is this based on equity or what the parties can afford or what? It seems likely LowT ends up eating most of that even if the ex gets assigned some part of it because she's not likely to have a significant income for a while.
