LETS BREAK THIS DOWN because I legit think the DA is trying to make sure the kid wins, and I can support my assertion. Starting on page 3 of the criminal complaint which I have provided.
Paragraph 3: Establishes Rosenbaum as the aggressor, establishes the loud bang BEHIND Kyle, and that Rosenbaum was throwing things at him

Paragraph 4: Notes Kyle IMMEDIATLY tries to come back to view it. This is important because if Kyle says "I wanted to try to help him, but realized he was going to die anyway" you remove any form of malice and Self-Defense is easily on the table.

Paragraph 5: Establishes that Kyle's FIRST option and attempt was to run, to disengage, to get out of there. This isn't even REQUIRED in Wisconsin for self-defense and goes a massive way to proving he only shot when forced to.

Paragraph 6: Kyle exercised clear gun control, keeping his gun lowered. he also fired quickly, not slowly, meaning every shot willc ount as one instance of aggression. The DA is leaving no wiggle room to claim he shot in cold blood.

Paragraph 7: Dude tried to grab the kids gun, self defense provable right there. Combine with everything above we have a kid who was chased by a violent aggressor, who tried to disengage before anything else, shot only once he was given no choice, and then circled back to try to help. This by the way is the ONLY case that isn't Murder 1, and the only one in doubt for losing. And the DA has, FOR KYLE, made the complete and total case for self defense in the criminal complaint.

I've visited NYC since this shit happened and this article is completely bullshit. The city is bleeding like a stuck pig. All of the flagship stores in 5th ave and the surrounding areas are boarded up and closed. I walked down formerly busy streets and felt like something was off but I couldn't say what it was. After walking another block, I looked around and realized that in the middle of the day in downtown Manhattan, there was barely anyone there, the streets were empty. I sat on a bench to wait for the next person walking past/car driving by, set a stop watch, and waited. 10 minutes later, I saw a moving van passing me. This is on the same street where only a year before it was completely packed during that time of day. People are moving out of NYC at a rate that's never been seen before and only the criminals are staying. Shootings have gone up drastically and they even happen in the wealthy parts of manhattan. Deblasio should be hanged for what he's done to NYC.

Bicepless Bandit is alive and salty enough to sue, but it wouldn't be wrongful death, and his statements AFTER the shooting should not play well for his case in a civil suit.

And self defense as a justification for actions doesn't fly out the window just because it's civil. Kyle did about as good a job as he could have giving the people he ulimately shot an "out" by running until he no longer could, and only engaging people attempting to attack him at point blank range. I think even in a civil context he's in good shape and the legal team he currently has is perfect for dealing with that kind of thing.
