For now the appeal case will be with a judge or more Judges, and if appeals go for Vic in anyway then a trial with jury might happen as far as I can tell.
I hope it does go to a jury then. Not only would Monica and Ron look like complete fools in front of a jury, but there would also be attempts at jury tampering by KV folks, I guarantee it.

Sanctions are punitive, which is the court saying "you did this bad thing, don't waste our time or money again."

The attorney fees are a separate, and are to compensate the defendants for what was ruled a frivolous lawsuit. The reasoning for that is that they shouldn't have had to spend the money to defend against someone's abuse of the legal system.

Roughly speaking Moron got $100,000 (jointly), Marchi got $50k, and Funimation got $50k, plus a few thousands here and there for fees and expenses.

Even if Ron has a policy that will help cover him the insurer can only recover the amount of the judgement from Vic if I am not mistaken. If that is incorrect let me know. Ron would still be stuck paying 182k. Could that be the reason behind his obsessive stalk & spam episodes? Or is he just going to spew 182k worth of venom all over the web?
 
Honestly my faith in a jury not getting baited by the KV guilt tactics is pretty low.
The average person doesn't live on twitter and doesn't care about weeb shit. If it comes to trial I'm sure Ty will just dismiss any dangerhairs he finds in the jury pool.

This is why jury trial terrifies them. Vic comes across as a normal, if slightly nerdy, guy. The defendants are all weirdos who spend too much time on social media, and a faceless company that does cartoons.

Honestly if this gets to a jury I wouldn't be worried about this at all. The problem with social media, and especially niche social media like anime shit, is that it amplifies certain views that aren't necessarily representative of the whole. For a perfect example of this effect look at the Gibson's vs Oberlin lawsuit. Given the nature of social media it would have been pretty easy to write the Gibson's off as fucked, yet when it got in front of a jury in the real world the University got absolutely cockslapped by reality.

A jury trial has been requested. In a jury trial, the jury and judge have different roles, which work together in tandem: The jury has to decide questions of fact, and the judge has to decide questions of law. It's the jury's job to look at the evidence and determine what the facts are, and then it's the judge's job to rule on how the law applies to those facts.

However, during the TCPA, the ruling is entirely based in questions of law: does the TCPA apply to the claims made; has the plaintiff made a prima facie case for each essential element of each claim; and if so, has the defense made an affirmative defense on which the case should be dismissed as a matter of law. The facts themselves don't matter at this stage; all questions of fact are supposed to be resolved in favor of the plaintiff, so there's no need for a jury to rule on anything. It's entirely handled by a judge.

If the appeals court reverses Chupp's dismissal and sends some of the claims back (and assuming that further appeals don't result in re-dismissal), then eventually they'd come before a jury to decide the questions of fact. But that only comes if the lawsuit gets past the TCPA.
