I'm slightly more optimistic and think (just spitballing) that the odds are more like 35-40% of something coming back. I also think there is a somewhat higher than average chance of SCOTX hearing it regardless of how it goes. A possibility Nick didn't consider is the somewhat unlikely chance of a dissenting opinion, and if there is such an opinion the odds are much higher of SCOTX hearing it.
I could easily see a mixed decision making both sides unhappy enough it's just a matter of what everyone appeals.

A 35-40% chance of something coming back still means that the most likely outcome is everything staying dismissed.
As far as the chance of the SCOTX hearing it, Nick has mentioned that it would raise a bunch of open questions about the TCPA, but something to also consider is that this case is being handled under the old TCPA, so their ruling would be less relevant as far as legal precedent goes. They might prefer to wait for a landmark case under the new TCPA to come along before they bother dealing with it...

Obviously this statistical argument should be taken with a grain of salt. For one thing, it implies that every case that gets appealed has the same probability of being successful.
