Government backed loans currently have a stay on evictions and foreclosures as part of the CARES act, and he had an FHA loan. That protection expires soon, or actually may already have recently. I believe it’s Aug 1 but I’m currently occupied with other parts of the bailout

The part of the CARES act my job is covered under is active until September 30th. I'm not sure if the part covering foreclosures/evictions/etc is on the same deadline, but wanted to put it out there.

It provides foreclosure protections for borrowers with real property secured by federally backed mortgage loans.
Borrowers who affirm they are experiencing a COVID-19 related hardship can request a forbearance from their loan servicer of up to 180 days, which can be extended for an additional period of up to 180 days.
Except with respect to a vacant or abandoned property, servicers may not initiate a foreclosure, move for judgment, or order a sale, or execute a foreclosure-related eviction or foreclosure sale for not less than the 60-day period beginning on March 18, 2020.


This doesn't really clear it up, tbh. He stopped paying in April 2019, so he can't claim a hardship due to Covid (also the fact that he's making more money now). Looks like maybe the last part could apply on the move for judgement or sale.

Wouldn't you have to do something to apply for it? DipShit has just ignored it like it isn't happening.

Maybe the court is just automatically doing it? Or perhaps the moratorium did run out on June 30th, so all the people who applied for relief are now having their shit continue on, flooding the court?

The gist I got poking around was more of a blanket moratorium although some did mention applying for relief. At any rate the most infuriating thing about Fill is how shitty he plays life even though his difficulty setting is far below easy. I am still amazed at how little real hardship he’s endured in life.

I think there’s probably a backlog in the courts as well as confusion over government backed mortgages, as well as a lot of judges, clerks, and general worker bees staying home. In my state civil courts are nearly shut down except for domestic violence restraining orders etc. and CT may be similar

No, nothing. I found a few cases way upthread but the the foreclosure process in Connecticut moved glacially even when the defendant no-showed and the country wasn't having a coof problem.

All foreclosure sales are also delayed until at least late this month. From what I can tell foreclosures in Connecticut go through the regular civil courts instead of a dedicated housing court, so the judge may just be treating this as a very low priority because approving the foreclosure would still leave it in limbo for the next three-plus weeks.

So in the meantime it is still in his name? So he still is responsible for the mortgage and HOA fees?

So what does that actually mean for Phil? If anything at all.
Keep in mind I am not an internet lawyer from Minnesota. It looks like he has to respond to this notice by October 22nd. This has to be one of the following: an appearance (show up), answer (letter), or just a enter a plea. If he doesn't do this MidFirst may get the judgment by default. The clock is now clicking, Phil has to make a choice.

Edit:

MidFirst has a decent chance to try and rip over $60k from Phil's hands. I wonder if Phil will drive down to the mail box for this one.
 
Wouldn't a response indicate he will continue paying on the condo? he doesn't want to respond right?
