I'm not totally sure but I think a no contest plea isn't always available, and can sometimes be rescinded.I don't have much knowledge about US laws, so can anyone explain to me why didn't he just stick to no contest plea? It seemed a better deal than this.
The problem wasn’t that he couldn’t plead no contest anymore, it’s that the deal with the prosecutor that was offered was available for him to plead no contest at the start. Prosecutors do this to get things through the system faster and get closure for all parties. Russ, in typical idiot Russ fashion, decided the if the deal included a mental health evaluation he would rather go to trial. Regarding who the evaluation must be completed by and who decides:
Since he has been ordered to receive a third-party evaluation that means he does not get to use his prior providers or a DOC contracted psychologist. Probation has a list of providers and agencies with whom they recognize provide assessments meeting minimum court standards and he will be told to choose one of those. If he wants to choose his own person outside of that he can certainly go to someone else and have the evaluation completed but he will have to justify the reasoning for the outside evaluator. He could have all the evaluations he wants until he finds one he likes, but for any to be accepted, they’d have to include collateral from the courts. And so I doubt it would do much good and he cannot afford to eval shop. But...Technically, if it came down to it and he had managed to get an evaluation from someone new who said what Russell wanted, judge would bring in the evaluator and question them on their credentials and expertise and the attorneys could go so far as to question them on their findings and have their own expert witnesses to impeach testimony or dispute evaluation.
I highly doubt it will ever get that far for a B misdemeanor. Most of the shrinks who can be bought off to say whatever are too expensive for him to afford and the rest would see how impossible it would be to justify anything but a recommendation for intense therapy and wouldn’t risk their license over Russell.

Yes. I don't think it's even possible for circumstances to exist that would give a court the power to tell someone that they can't have contact with any adult women. That's an extremely broad restriction on someone's right to speech and association. If someone had offended against a child they might be ordered to have no contact with minors, but that's about as close as it gets. Literal serial rapist killers are still allowed to receive and respond to mail from women while they're in prison.So he got probation-but what does that mean, exactly? Do you know if whoever does the psych assessment would be given any information regarding what charges Russhole plead guilty to? Would they possibly be given any of the evidence submitted by the prosecution/Erika's attorney on the case? I hope so, because the latter in particular would nuke any chance Russhole might have to try to convince the doctor that he's not a creepy stalker and sex pest. Can you imagine Russhole being put on the spot by a psychologist asking him why he was threatening poor Erika with going to her home and committing suicide outside it? I know we'd never hear about the true results of his eval, but it would still be nice to know if the evaluator would have those sorts of background details and documents to help make their judgment call.

I just thought of it because now, instead, he does vaguebooking, like that “listen to both sides” post. Russ won’t chimp, he’ll just vaguebook and we’ll have to read between the lines. When things go bad for him, he rarely mentions it until he makes up a good story about why he was wronged. He has been silent before.
So he got probation-but what does that mean, exactly? He has to go to therapy, and he has to leave Erika alone? Can he still contact other women? Even if not, He may, although he may lay off the “I sent you an awesome DM” for a while. He’ll still send the DM, but may be hesitant to make it public. He may stop his reviews-or not, since he doesn’t connect them with women, but companies. I don’t think he will have any issues leaving Erika alone now, but there is no way he won’t contact other women. Is that considered a probation violation? I’m thinking no, unless he starts stalking them-and then, most importantly, she’ll have to report it.
We all say Russ has learned nothing and it’s true. But he doesn’t have to rage quit on FB anymore, and I think he can harass a woman without anybody knowing. Unless she comes forward (and most don’t) who would know?
Maybe I’m misunderstanding what his probation entails, but I thought it was solely about electronically harassing Erica. Maybe it encompasses all females but again...they would have to say something. I don’t think the Court can say “You can never speak to a woman again.”
It will be interesting as time goes on, what slips. I’m not as certain or as enthusiastic that we’ll get more info on this, or hear what the psych says. I think we’ll see lots of posts about national donut day, or whatever, and maybe some songs about celebrities. Back in his fantasy hollywood dream world until the 18 months is up, Covid is over, and brothels let him in again.
He slowly stopped doing that. It really goes to show how many people he has driven away that he doesn't have to worry about 'friends' responding to his posts anymore when he's not around.
