Not true. He could sue him in Texas and claim Texas's long-arm statute covers Nick's behavior and therefore, there is jurisdiction in Texas and Nick has violated his rights under Texas statutes.

If the amount in controversy were substantial enough (exceeding $75,000), Nick could remove it to federal court under the diversity jurisdiction statute. So Ron could keep his action in Texas state court by limiting the amount in controversy.

Of course, he'd then have to be on the receiving, i.e. reaming end of the Texas SLAPP statute that has so far benefited him. I guess the question is, do you feel lucky, punk?

There are few things on earth more insanely stupid than filing a frivolous lawsuit against a lawyer. See Nick as a Lawyer has reasonably free access to the Courts. He can do whatever he wants just for the cost of filing fees. And he has enough legitimate knowlege to insure that RonRon gets bent over in legal fees, before blasting him with an Anti-SLAPP motion in whatever Jurisdiction it ends up. (After a long drawn out and expensive jurisdiction fight. Go look at the Waid v Meyer thread). The funniest thing in it all would be the point where Ron gets forced to pay Nick's fees at market rates for defending himself.
