I doubt it would withstand First Amendment scrutiny, so I'll just hope Netflix's legal bills are absurdly big.

I'll note, though, that the film itself could be protected under the First Amendment while the advertisements are not. This has actually happened in the 2008 Supreme Court case United States v. Williams. The defendant in that case advertised material as containing pornographic portrayals of children, although this was not true. He's definitely stagnant and likely in the beginnings of a slow decline, but he does have a couple things going for him. The first is that he keeps most of his sperging to twitter. Despite what twitter and the people who use twitter think, most people don't use twitter or care what is said on it. The second is that his paypigs seem to be content with the decline is show quality. There are plenty of current and former listeners who post here and elsewhere about how the show has gotten worse, but we aren't seeing any kind of mass exodus. Not even one where a lot of people aren't renewing after they get the notification that their card was declined because it expired or whatever. This year has been one that keeps on giving, so I'm not counting out a scandal that rocks his fanbase dropping, but keep in mind that it's going to have to offend his degenerate fanbase to their core in order to have any immediate effect beyond speeding up the slow decline.
