False. The pepper spray released in the Rindhole shooting in Portland was due to him shooting the pepper spray canister. And also Rindhole was not defending himself, he and his team stalked the victim and murdered him. There was no conflict or confrontation, just straight up premeditated murder by a team of hitmen.

He was, apparently. 9News. The local NBC affiliate. The other person arrested who they let go was the producer.
DPD originally said that two suspects were in custody, and later found that the second individual was not involved in the incident. DPD said the second individual was a person of interest at the time of their arrest.
A 9NEWS producer and a 9NEWS contractor were taken into custody.
DPD has since said that one of the two people taken into custody was not involved in the incident but was a person of interest at the time. The 9NEWS producer is no longer in police custody and is not a suspect.
A private security guard who was hired by 9NEWS is the suspect detained by DPD. It has been the practice of 9NEWS for a number of months to hire private security to accompany staff at protests.

The question will have to be if a jury would find that pistol guy felt in reasonable fear of his life. From a man 10 feet away using pepper spray?

Only possible route I could see working is if pistol guy can claim he was fearful of being incapacitated and disarmed.

From what it looks like in the video the shooter had already drawn his weapon before being pepper-sprayed. The shot comes in at the same time you can see the orange mist which would not have been possible if the shooter had not of already drawn his pistol.

Edit:
This seems to imply that it was most likely the person shot who was acting in self-defense.
