An Arizona man has been arrested after he accosted two young Black men outside of his mixed-use commercial/residential property over the weekend.

As seen in captured video, the man, Paul Ng, stopped the pair, who were reportedly recording a YouTube show, and inquires what they are photographing. Asking Ng why he is interested in their presence, the young man says, “Do you know a lot of white men are doing racist things in this world, sir?”

“Okay, that’s fine. So what’s your point? Why are you here?” the young man asks.

“Because this is a no [n-word] zone,” Ng replies.

The young man paraphrases the statement, saying that it can’t be a “no [n-word] zone” because “I’m here.”

He tells Ng to step back; neither man is wearing a face-covering amid the coronavirus pandemic, and Ng mentions that they should be “six feet.”

The young man says that he feels threatened and tells Ng that if he touches him or his friend, that he is “going to lay his bitch-ass down.”

Ultimately, the young man who identifies himself as “a famous YouTuber” shows the business where Ng is using a leaf blower, saying that it was his establishment. According to the Phoenix New Times, that business clarified that Ng lives in an apartment upstairs and is not associated with the store.

The young man, LilAJDre, shared the video on his IG TV channel and YouTube page, and it has racked up hundreds of thousands of views. It was also shared by activist Shaun King, whose massive following helped the incident rack up over a million views.

Ng was arrested with disorderly conduct by Scottsdale Police.

The man was previously an independent contractor with Russ Lyon Sotheby’s International Realty, a luxury real estate firm. They issued a statement that said Ng had been fired and his license severed.

The company also said they plan to donate some of Ng’s previous commissions to charity.

No it wouldn't have. Nor is it illegal for them to say if you lay a hand on me, I'll knock you down. He wasn't threatening them. And they were only threatening him if he did something that would be illegal to do. You're allowed to state your intention of defending yourself if attacked. Neither of them should have been arrested. Ng is obviously an asshole who is going to pay the penalty for being publicly known as an asshole nobody will want to associate with in the future, though. If your business is selling luxury property (hard to believe you are that successful if you are living above a bait shop or whatever the fuck that place is), you should probably comport yourself with a bit more dignity. The clientele don't like aggressive weirdos.

And it doesn't mean they're automatically illegal, just that they may be not protected by the Constitution. What is more important is the language of the Arizona disorderly conduct statute itself. Specifically:

A. A person commits disorderly conduct if, with intent to disturb the peace or quiet of a neighborhood, family or person, or with knowledge of doing so, such person:

1. Engages in fighting, violent or seriously disruptive behavior; or

2. Makes unreasonable noise; or

3. Uses abusive or offensive language or gestures to any person present in a manner likely to provoke immediate physical retaliation by such person; or

4. Makes any protracted commotion, utterance or display with the intent to prevent the transaction of the business of a lawful meeting, gathering or procession; or

5. Refuses to obey a lawful order to disperse issued to maintain public safety in dangerous proximity to a fire, a hazard or any other emergency; or

6. Recklessly handles, displays or discharges a deadly weapon or dangerous instrument.

B. Disorderly conduct under subsection A, paragraph 6 is a class 6 felony. Disorderly conduct under subsection A, paragraph 1, 2, 3, 4 or 5 is a class 1 misdemeanor.

I'm going to assume, since it isn't specified and is the only applicable part of the statute, that he's being charged on the basis that he used "abusive or offensive language or gestures to any person present in a manner likely to provoke immediate physical retaliation by such person." One is generally presumed to be capable of controlling one's actions to the point of not instantly assaulting someone upon being addressed with a slur.

Here's at least one case with the use of "nigger" being considered a violation of the statute:

I won't go into it much, but it didn't involve just that. He also threw a soda can at one of them, and repeatedly shouted the racial slurs, particularly, yelling "fuck you, you goddamn nigger." This is the kind of conduct much more likely to lead to an imminent breach of the peace than merely uttering the word. There aren't any magic words proscribed by law. So the conduct here would have to be judged under the totality of the circumstances, not because Ng simply uttered a single magic word.

This behavior would not have led to a breach of the peace by a reasonable person, and in fact, it did not in this case. I don't think it should sustain a conviction.

I should note I don't think the police were excessively wrong in arresting him although I don't like someone being arrested purely because of public outrage. The call is close enough I think there's probable cause. I'd just rather not see political arrests like this.
 
Never EVER interact with a black person holding up a smartphone, and calmly try to leave the general area if they pull one out. 100% guaranteed they are either trying to goad you into doing something "racist" so you get your life ruined by the woke mob, or worse, they're about to violently assault you and upload it to youtube/insta for the other ghetto trash to hoot and holler over.
