They do it because they want to be one of the earliest 'reputable' sources to call certain results, because that gets them more traffic / clicks than others in the press. They are willing to risk humiliation if it looks like a most probable thing.

Yes they are required to keep them for this case specifically. There are many states that have auto recount laws if the vote is close. I expect a half dozen recounts at least. Not that it will change anything. The recount in WI 2016 netted Trump like 120 votes.

The real question is what happens to all the ballots that were done in person by sharpies supplied by polling staff. Thats pretty fucked if people were screwed by the polling staff without recourse.
