The courts are leaning in favour of Republicans now. That's why Biden made his "getting out of whack" comments about wanting to pack the court. That won't happen, though, since Manchin probably won't back court packing as a moderate so they can't get the votes for it even if they pick up both the Georgia senate seats (which is itself unlikely).

Even then I said that Manchin probably won't vote for court packing. He's a very centrist Democrat in West Virginia, one of the reddest states in the country, so he could lose his seat easily.
