Pennsylvania has already certified its electors, and the timing of Alito’s order means SCOTUS wouldn’t even be able to act on this before the federal safe-harbor deadline—which is December 8. I assume this means Alito doesn't really give a shit about these legal cases, because federal law provides that state certifications by the safe-harbor deadline are conclusive.

Safe harbor is a deadline for new cases to be filed. Bush v Gore was decided that constitutionally valid recounts could not be done by that date and so the state legislatures slate of electors would go to the electoral college

Safe harbor is the deadline for recounts and I think new lawsuits. It doesn't affect the SCOTUS ruling on existing lawsuits. Suppose SCOTUS rules on or after December 8th that the process was so flawed it cannot be remedied and the state legislatures need to decide how to proceed.

In 2000 part of the justification for the ruling was that safe harbor had already arrived.
