This is part of what I was thinking - it might be procedure that, if his testimony isn't enough to sway some cheese, that he has to actually argue before a judge that he was just shitposting.

I've watched this happen in smileyface autism land, granted it's run through a ruthless Russian corporation and not an individual guy. Someone posted a troll guide to r/iFunny that would get newfags stuck in the Brazil servers and the subreddit mod pinned it (don't know if it's still up). That was almost two years ago. Since then, and especially since this Summer, a billion newfag accounts have jumped over and hurled their truckloads of fedbait into existence. Not only is this steadily getting people on lists, it's caused hellish restrictions to the point that every other meme anyone posts will get deleted. The FBI is a good lesson in object permanence and you should heed by it
