Yes we have all seen the video, yes we all know its baked, yes its his fucking stream. The thing is, in law there are very very strict rules about what evidence can be admitted and what evidence cant, and especially the chain of custody of that evidence. Usually for a video, or picture you need someone who was there when it was taken to "lay foundation" and say something like "yes that is baked alaska in the photo". Otherwise its considered an out of court statement and is very difficult to admit.
Baked's lawyer was probably just trying to point that that the DA needs to call some witness to lay foundation for the video, without literally saying that so as not to do the DA's job for him. T
Your explanation would make sense were this not a pre-trial hearing, which is not subject to the rules of evidence.

“Getting caught up in the crowd” is the type of excuse you make if your local sports team wins the championship and a cop busts you for climbing a street light at the celebration. No one can seriously use that as a legal defense after they cross multiple police barricades, walk a few hundred yards past them, go up a few flights of exterior marble steps, enter a smashed window or door into a federal building, and wander around in offices of the federal government for twenty minutes. That’s a special kind of stupidity.

(Not to mention five people died, millions of dollars of fed property was damaged or destroyed, and a basic function of government was temporarily stopped.)
