For me, the highlight of the show was the live reading of my Commi3 Mark'd version of the original pages, which I have called NOT Dark World. It attempts to summarize the version of events presented by Martina while poking fun at the absurdity of the whole situation while making meta references and easter eggs for people with intricate knowledge of the case and ofc shameless self promotion.

I watched parts of the JDA stream with her on and she looked legit miserable so it was nice for me to see my shit jokes crack her into uncontrollable laughter. Made an afternoons trolling feel like it had been worth something, you know?

I'm not buying this message either. I didn't keep up with her too much, and Smug's write up was probably the most I've ever looked into her and I may delve deeper when I get time. Maybe it's the time I spent screwing around on the internet that I automatically get suspicious when someone cries victim.

But, I'll reserve my judgement and see how this plays out. Personally I want a more full blown Vikki vs Martina throw down. Cat fight, fuck yeah.

There's a thing called Common Law Trademark. Once Martina began trying to make money using her image as "Lady Alchemy" she had legal ownership over it.

Registering the trademark gave her addition protection, but it wasn't necessary. Anyone trying to register a trademark for "Lady Alchemy" in a way that might cause brand confusion for Martina would need to do a good faith search of potential Common Law Trademarks before proceeding, and in this case, it's clear that anyone involved in this comic would have been aware of her claim to it.

This. It's an open and shut case and it's her rights. It's clear cut.

So, for like like 9 whole pages they have her doing nothing of merit and made the story more about their side characters. No wonder she fired those guys.

There is in total around 17 or 18 pages complete and Lady Alchemy was in less than a quarter of all the material. There was more pages of pipe smoke magic lady and Major Grubert running around that I cut from my version. The first proper appearance of her (outside of like posters and shit) in the original wasn't until page 16

I moved that up in the running order quite considerably. The original was a shambles and I did the best I could to save it.

There are at least 3 other pages that I have seen in the emails and other evidence that aren't included here though.

Those guys say that they had the book 90% percent finished when Martina fired them. If this was true they could easily recolour the hair and change her name and launch their own campaign. Thats what I'd have done.

Vikki's point that you can have two similar trademarks, covering two different commercial products, owned by two different parties, is sound. Happens all the time.

Does that, or could that, apply here? I dunno. I confess it might be a bit of stretch if the character in the comic is meant to be the same as her stripper burlesque character. I just find it maddening she didn't comprehend what Vikki was arguing. Instead, going straight for the high school girl insults.

But she's got other issues.

Like the fact the copyright on artwork can be legally distinct from her trademark of the character.

Or, the more pressing concern of "Whoops, I spent all the money! Gib me more so I can actually ship the product! Tee hee."

I am not so much taking a "side" here as I'm pointing out Martina doesn't come out of this looking good, and this whole thing is pretty clearly a shitshow so far.

'Groken' is the project, here's his blog showing some of his work https://mitografia.tumblr.com/. One of the things that kind of separates his work from others is his use of watercolors.

I got into his art when he was on red hood and the outlaws. Kind of reminds me of walt simonson, sam kieth and larry elmore (from Dragonlance, D&D, etc).

You're right and wrong here. A federal trademark is necessary to strengthen the protection of the brand. A common law trademark is only covered by state law and restricted to a geographical area.
A "good faith" search is required, but a lot harder to prove. Since we're talking about comics and not burlesque shows there's no reason a search for the name in comics would result in discovering a stripper act.

Martina is probably covered here but these types of lawsuits can get expensive and a federal trademark is much easier to defend. Comics is a niche market and a circle jerk so they were definitely aware of "Lady alchemy" used in comics.
