In Virginia, incest is only illegal between parents and children and grandparents and grandchildren (under the criminal code for sex offenses it appears). Then there are prohibited marriages, which includes siblings and aunt/uncle and niece/nephew.

First cousin marriage is legal in the State, so I would presume that intercourse is legal as well. I'm not completely aware of the accusation here regarding incest, but that phrasing is indicative of something, as it's not an outright "I didn't fuck my family or commit incest".
