A 7-year-old boy from upstate New York has been charged with rape, a report said Tuesday.

The child, of Brasher Falls near the Canadian border, was arrested by state police in connection with an incident that happened on Thanksgiving, according to local station WWNY.

He was charged with third-degree rape on March 23, the CBS affiliate said.

The boy was released and will be reportedly tried in Family Court.

A Queens attorney who handles youth defense cases told the station the case is “absurd.”

“Instinctually, it shouldn’t happen that a 7 year old — I don’t think you even could really realize what you’re doing at 7 years old,” Anthony Martone told the station.

“They’d have to prove he actually physically committed this act, which to me it almost seems to be an impossibility.”

Martone reportedly said it appears the boy is being charged as a juvenile delinquent, but a bill pending in Albany would raise the age threshold for that charge from 7 to 12.

If he raped a 24 year old woman I'd suspect she raped him and there's a stupidly written law that makes it so the male has to be the aggressor even if the woman initiated it.

I don't see how you could charge him with rape even if he raped a child half his age. It would be messed up but he's still a young child himself. Shouldn't they be looking into why a 7 year old would do that in the first place? There's a 99.9% chance this kid was abused himself and is mimicking what was done to him.

I literally can't think of a way to justify this charge, no matter the scenario, we're still talking a young kid here.

Third degree is:

First Degree is forcible rape, suggesting its possible he is accused of raping a potato or something. First degree would also be if the victim was under 11 so we can assume that the peer-to-peer thing is out (unless they thought it would be easier to push through secondary or something?)

Third degree rape has a maximum of 4 years punishment so he'll before high school if he got convicted.

I think "rape" is broad enough to encompass "forcible penetration with a foreign object" in a lot of jurisdictions but I don't really know anything about nothin'.

Good point. If we consider object rape then seven year old perpetrators aren't unheard of... I mean if autobiographical books are to be believed, even seven year old females have done that shit (and apparently aren't ashamed to scream to the world that they did it).

Venables I think established the law in the UK of 10 being the age where you are expected to comprehend the morality certain acts. I'm not so sure that a 7 year old would fully comprehend the gravity of what he's doing. Then again, we have a lack of details. Could have been playing doctor for all we know. I suppose thats why they are going with the 3rd degree, apparently removes the whole need for intent.

Family should be looked into if it wasn't a case of kids playing doctor and he did do the act. How does a 7 year old know what that shit is without seeing or enduring some stuff.
