My understanding is that it's now on Ralph to sue this site. The counternotification would include information about where to send the lawsuit. If Ralph does sue, we'll get a situation where the courts have to apply the fair use test to the content, which is always decided on a case by case basis.

If Ralph doesn't sue, the video comes back.

The beauty of this is Ethan will counter counter, and at that point Youtube will just give up and keep it down while waiting for court papers.

Youtube's copyright system itself is shitty, but hopefully there's a backup of the stream somewhere.

You'd think a guy like Ralph who's been around the block a few times would understand basic bitch fair use. Commercial availability is often a factor when sentencing fair use cases (such as determining damages) but it has next to nothing to do with determining whether or not something is or isn't fair use. IANAL but from the way these things usually go down it tends to be that if the content is transformative, such as putting commentary over it and only choosing segments to pass commentary on, then it's clearly Fair Use. Especially when the audience the content is intended for is distinct from the audience the original content was for, i.e. the people who post all day about how Ralph is awful are likely not the people interested in support Ralph financially. Did Ralph learn nothing from Sargon's lawsuit?

I guarantee that Ralph will hit up Rekieta in the DMs and retract the claim before it goes to court. Or he'll play a game of legal chicken with Null, and we'll figure out if unstoppable autism can beat an immovable gunt.

I can almost see what he means by 'lowering the value of the original material'. In the paywalled content, Gator gives a take on how to 'dry up pussies'. This is a field in which Gator is not only an expert but perhaps the most authoritative source out there. You gotta do what you gotta do to protect Gator's intellectual property rights.

Probably more to do with the fact that Ralph is completely irrelevant at this stage. Who outside of a handful of gunt suckers even knows or cares about Ralph at this point? He has been reduced to streaming to a bunch of paid for bots on some backwater platform no one fucking knows about.

Ralph just isn't worth the effort.

Ralph won’t do anything. He won’t respond to the counterclaim and will say something like “well I guess it technically is fair use but it shouldn’t be”. Hope rackets does a stream on this.

he does know that null makes no money from the streams right? I mean he has to cus in the last stream, the one he flagged, null talked about it in the first 15 minutes. He literally said how he uses the streams for fun now, cus he can’t make money from them.

Also as far as “some footage from a movie”, has he never seen any of the hundreds of film review channels that will use specific clips from the films in question, even more recent ones as part of criticism? It is like he has never used youtube before. Null played like 5 minutes of a full stream, he used specific time stamps which show that he only showed what he meant to criticise. He must be drunk or something rn tweeting this on... Easter
