He definitely pitched the gun than raised his hand. And spun counter clockwise obscuring that part of his hand before he raised them up. I can't see how the cop will be convicted.
Yeah, watching the video I think I might have made exactly the same mistake as this dude did.

You've got someone doing something behind a wall that you can't see and then he wheels around with a hand coming from below the waist as he starts to raise his hands.

If I saw the suspect with a gun before, and then I can't see his hands, and then he turns around and I don't know where the gun is as his hand is coming up from behind a solid opaque object and all this takes place in a about a second...man it was a mistake but an easy to justify one.

The irony is if this kid had actually just stopped dead in his tracks before he got to the wall, and obeyed every instruction he probably would have lived even with a gun in one hand. But those are a lot of ifs.

This makes me think he was originally planning to fire at the cop, but his weapon malfunctioned so he decided to ditch it. At first, I thought the cops might have cleared it before taking the photo for some dumb reason, but you can actually see it sitting just like that in the video.

Good catch. You're not going to be carrying it with the slide locked back. Magazine is in, so either locked back on an empty or a jam.
 
Chiraq vs The Military would be an interesting thing to watch. National Guard has too many fatties and females to face a code red chimp out like that.

I'm telling you. If you're called to deploy in Chiraq, bring EVERYTHING. You're going to need it. It's a literal warzone.
 
It doesn't look good, and the press should be all over it I expect. But at the same time, could a person reasonably be expected not to shoot in that situation, after having made the decision to shoot? There's a one second difference between the kid reaching for the gun, ditching it, and putting his hands up. Clearly, at the instant the cop saw him reaching, the cop made the decision to shoot. The human brain can only process things so quickly, especially if those things aren't expected or anticipated. I'm not a cop, but if I see someone running from the cops suddenly reach into his waistband, my automatic assumption is he's pulling a gun to shoot the cops with, and I suspect that was the cop's assumption, which led to his decision to shoot. He made the decision and made the shoot in the span of 1-2 seconds, so was that enough time for the cop's brain to process the new images before him and change his mind? I don't think so. Chicago is going to get extra spicy over the next couple days, though. Of that I'm certain.
A person can draw a gun and fire a single shot with reasonable accuracy in about two seconds. Once that suspect decides to shoot, the cop is behind the power curve and you have to be fast as hell to catch up.

The cop fired a single shot to stop the threat and immediately rendered medical aid. He did not magdump the kid nor did he wait a couple seconds to shoot again.

Not guilty.

Any kiwis want to test this out, go to an outdoor range with two other friends. Rent two lanes next to each other and do a drill. Both loaded pistols in a holster. Your friend get to decide when to shoot, your objective is to outdraw and be faster on target than your friend.
 
If it works for you, I guess. Much more fond of Browning HP variants and SIGSauers.

Different tastes I guess. Ruger makes better revolvers, or at least they used too. I hear some of the recent pistols were okay.

This little joggers mistakes are much more foundational than his choice of sidearm though.

About any places with a melanin concentration higher than 70 percent is going to be a warzone.

West Virginia is if iirc the poorest state in the union or one of the poorest and I don't expect Chiraq stuff there. Or even Mississippi.

Can we just be honest what a clown argument this is?

Immediate aide to someone who was dead before he hit the ground.

And again we've had several weeks of the Chicago PD, DA, and the Mayor making claims form having a gun in his hand to pointing it at the officer only to find out that none of that was true.

Why even make these claims when you know you're going to have to release the video?

I'll also point out that once again the officer had a military background which seems to be a common theme with these shoot first ask question later shootings.

I thought it might've just been locked back on empty from whatever shooting they'd been doing earlier. honestly. I guess it's possible, seems like a bit of a reach but we'll never know now.

You're right, it was a dumbass move to say he pointed it at the cop. But the dumbass kid CLEARLY had a weapon, withdrew it, pitched it behind the fence (unknown to the cop), spun to obscure that side of his body, and raised the hand the cop had JUST seen him holding his gun in while turning to face the cop. All within less than a second. Kid made the bad move here, ultimately.

I did three tours in Iraq, miss me with that bullshit.

This is the sort of thing the Obama administration was trying to drum people out of the service for had it been some rando Iraqi.

I'm only making two points.

#1 The Chicago PD, DA, and Major spent weeks lying about this case. There's no gun pointing at the officer and they knew it.

In fact the Chicago PD heavily implied Adam was the one shooting the gun when now they admit they have video footage of his brother shooting the gun. Again why lie?

#2 "Rendering aid" is utterly pointless to someone who you just shot in the heart and lungs with a hollow point and this cop knows it. He's going through the motions for his defense. Even if he was instantly transported to an ER this kid was dead.
