Yeah, watching the video I think I might have made exactly the same mistake as this dude did.Better shot, that's obviously a pistol with the slide back, but how's he going to notice that in a split second:

He definitely pitched the gun than raised his hand. And spun counter clockwise obscuring that part of his hand before he raised them up. I can't see how the cop will be convicted.
You've got someone doing something behind a wall that you can't see and then he wheels around with a hand coming from below the waist as he starts to raise his hands.
If I saw the suspect with a gun before, and then I can't see his hands, and then he turns around and I don't know where the gun is as his hand is coming up from behind a solid opaque object and all this takes place in a about a second...man it was a mistake but an easy to justify one.
The irony is if this kid had actually just stopped dead in his tracks before he got to the wall, and obeyed every instruction he probably would have lived even with a gun in one hand. But those are a lot of ifs.
