A diamond doesn't have to be massive and actually one that's too large tends to look tacky and reeks of trying too hard, but what makes the itty bittiness of that stone funny is the way she has her hand pushed towards the camera with her fingers splayed apart as if she's saying "Look at this amazing rock, my man got me!", when it literally looks like a chip that was left over when another, larger diamond was cut. one thing about prenups is that they aren’t actually as legally binding as people think. They can be rendered void in an instant by a judge, though I don’t know exactly how often that happens. Still, you’re definitely right that it would be smart for him to do it anyway. It certainly couldn’t hurt.
