Thats completely wrong. All content creators that rely on someone else's IP to make their own content are at the mercy of the owners of the rights. The burden of proof you need to even qualify for the Fair Use defense is incredibly high and monetization is often disqualifying, even if your work counts as transformative.
The mayor difference, more than actual laws or strictness of it, is the culture. Murican, or western, really, companies are often willing to let shit slide and even encourage fan work. If a company doesn't want you making money from their IP, you are pretty fucked.
