They can't retroactively make him a public figure. He's not a government official (unless you want to stretch more than Armzgurl's armz and say his being a beach cop in the 80s makes him a government employee). He's definitely not of general pervasive notoriety like the Rock or Tom Cruise or Orange Man.
And, other than a general denial, he hasn't talked about the allegations in hopes of influencing them. Nick or Doucette are more limited purpose public figures than Vic himself.
EDIT: There's also the fact that he didn't insert himself into the controversy, again like how Nick and Douchette did. The controversy came to him, not the other way around.
