Okay so it's important to understand that emulators are built by reverse engineering the hardware of the console you're emulating, which means that there are unknown things which a programmer wouldn't have access to that make the emulation more or less authentic depending on how good your emulator, well, emulates the real console. Basically it's two people attempting to do the same thing.

That's not how emulators work. No one making an emulator is stealing anything, because they aren't using the actual code that, say, Nintendo would have a right to. They are writing their own code to approximate the actual code. You'll be telling me OpenOffice is stealing from Microsoft Word because they both play .doc formats.
