Normally I'd agree, except they initially got involved in this case because of recordings of Chris saying he fucked his mom so if there is evidence of her having had sex I could see that sparking the arrest and initial charge for it.
I think a "rape kit" doesn't just look for semen, but instead is a general term correlating to a series of tests. These would include signs of struggle (bruising, cuts, ect) as well as any foreign pubic hair present around the gentiles as well as a blood test to check for things like roofies, and of course a search for any foreign semen. So even if Chris did wear a condom, his pubic hair being present could be enough to make the kit turn up 'positive' (this could, I imagine, be confirmed by genetic testing or by observing differences in hair color). And if Barb's mental decline is bad enough, I imagine she probably isn't showering daily. I could be wrong here so I welcome anyone to correct me.
I don't think she's mentally competent, I think that they just haven't charged him with rape yet. Incest is a relevant charge regardless of if it was rape or consenting. Incest isn't by default a consenting act, if a father rapes his 5 year old its still going to include a charge of incest among everything else.

None of this has been legally mandated by the state of Virginia. Just because he's younger, has access to her bank accounts, and brings in the dough does NOT make him her "caretaker" in any legal capacity. She's his mother, it's her house, he has autism. In the eyes of the state, Barb is the caretaker unless she is deemed incompetent and the responsibility is *legally* given to Chris. This has never happened.
