It already has been.

Incest is not by default a consensual act. Chris likely hasn't been charged for everything he is going to be charged with yet. It was just the initial charge to get him in to the jail. The lack of charges on Barb atm makes it look like we will see rape added soon.

I thought Chris's Barb-fucking fantasies were just intrusive thoughts that come from extreme aspergers combined with his weird perma-teenager lust. At the absolute worst I thought she might have rubbed against him in bed while he stress-sighed and made weird uncomfortable humming noises. Even after the audio leak I still couldn't fully believe it until Null posted the DMs about the "over 50s woman" where it's clear he wanted Null to guess who he was fucking.
I'm still not convinced that SLUT Barb wasn't gagging for it though.

If you were Barb and a policeman asked you if you allowed Chris to have sex with you or he will charge Chris with rape, what would you say? One way, Chris gets charged with rape, the other way, it's consensual and OK... at least that's what Barb would think. They get her to swear it was consensual and sign a document, and she gets arrested too. I can see Barb trying to protect Chris by getting them both in hot water. Neither of them will ask for a lawyer after the Game Place saga. They both hated their lawyer and blamed him for ruining their lives.

Didn't she try to claim she was driving when Chris got into the accident at Game Place?

If the authorities agree with Null that Chris violated his EPO he's gonna be a "no bail". Chris could easily spend a year in that county jail before he signs a DA's plea deal. If his autism card doesn't work and he's sentenced to prison he could easily spend another 4-6 months before he even gets transferred to a state prison.

Chris has hit the mainstream so the odds of him catching a sweetheart deal because of being an autistic troon are less and less.
