This guy is a fucking joke. He couldn't be more wrong in what he says if he tried. Let's count the ways he's retarded.
1. KF nor Jersh hacked the secureserver.tv database server
2. KF nor Jersh stole the MySQL dump that was derived from said hack
3. KF nor Jersh were responsible for making said dump broadly available
4. Under US law he has no standing to bring a civil lawsuit. The people whose information was released have the right to pursue redress for actual and perceived injury in civil court against secureserver.tv and possibly Ethan Ralph for not securing their data. KF nor Jersh have anything to do with this.
5. The relevant authorities of where the hacked database server for secureserver.tv resides (or the federal government if the hack was done across state lines or national borders) would have to pursue a criminal investigation to determine if a crime has been committed, and if so, they could pursue the original hacker for criminal charges. KF nor Jersh have committed any crimes.
6. Jersh & KF are covered under U.S. Code Title 47 Chapter 5 Subchapter II Part I Code § 230 Section C Subsection 1 that was enacted as part of the United States Communications Decency Act. The text of this subsection states: "No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider."
"Interactive Computer Service" defined as: "Any information service, system, or access software provider that provides or enables computer access by multiple users to a computer server, including specifically a service or system that provides access to the Internet and such systems operated or services offered by libraries or educational institutions."
"Information Content Provider" is defined as: "Any person or entity that is responsible, in whole or in part, for the creation or development of information provided through the Internet or any other interactive computer service." includes the following phraseHe nor KF can be held responsible for the content posted by a given user."
