A question for the lawfags. Is the fact that the state decided to prosecute this again an indication that they feel any kind of confidence about getting a conviction?
Prosecutors have an ethical obligation to only prosecute those cases that they feel they can prove BARD.

To be sure, there's some janky prosecutors that file just to fuck with people, or just in the hopes of scaring the defendant into plea bargain. But this is Ralph we're talking about. You just sit there and wait, and he ends up doing something stupid and illegal sooner or later. I'd trust the judgment and morality of a Virginia just about any prosecutor over the gunt any day of the week.

Will they win? I dunno. Not a criminal law guy. Worked in civil.
Do they think they can win? Probably, yeah.

Absolutely, The judge could revoke probation and choose to hit him with the maximum sentence as punishment for being an asshole.

Probation is always sort of a "gift" from a judge if that is handed down as the primary sentence to give you a chance to get your head out of your ass and straighten up. Judges generally don't like it when you spit in their face by violating probation by being a piece of shit.

I think it's pretty open and shut with victim testimony and Ralph's only counter being I DID NAWT I DID NAWT I WUZ HACKED N SHEEEEIT. Apparently, the prosecutor does, too. It's pretty rare for prosecutors to want to roll the dice when they don't think they have a 90%+ chance of winning, because it fucks up their record.

The one saving grace Ralph has is that Faith came out after the fact with a video that said he didn't release the sextape. That is why people think it is going to be hard to prosecute Ralph.

If I remember correctly, Faith in later texts with the Gunt expressed that she believed him when he said he was hacked and didn't release it, rather than her giving him permission to release it. Further, Ralph cannot argue that she consented because his own explanation is that it was a super-hacker. The only reasonable way to read this situation is that Faith was backing up Ralph's claim that he was hacked - but this is something which can be definitively shown to be utter nonsense in court - and any attempt to explain that Faith had given him permission can be dismissed as a post-hoc explanation.

If there is a decent prosecutor and the court really do want him to go down for this, he's fucked. With that said, my guess is that Ralph enters a plea and avoids jailtime, spins it as a win.
 
If only Ralph had shown Faith he changed.
Another coincidence I'm sure but he showed that on screen during his Friday the 13th show.
