Depends on if Lionhead kept the rights or Activision. If Lionhead kept the rights then it would belong to Microsoft. Looking through the list of IPs owned by MS it isn't listed so seems to be owned by Activision.

I just checked EU eBay and there's at least a half-dozen people selling the game boxed for less than $5. Activision games typically are not hard to find at all because of how many they produce.
