He clearly has the belief that people who don't do what he wants need punished. It's not like he'd be planning on killing her, it'd just be the natural escalation of his already depraved behavior.

So make of that what you will, I guess.

2. Say what you will about hookers, they have a pretty good survival instinct (and if they don't, they don't make it very long). If she and others are drawing on their experiences and using their first-hand insights to tell us that Russ has all the hallmarks of someone who absolutely will turn violent some day, then I think we should take their word for it and stop debating the issue. All of this "Would Pipsqueak ever get a gun" spergery starts to sound a bit like, "How many six year olds could you take in a fight" after a while. Most of the men here and some of the women don't perceive Russ as a physical threat and many of them discount the possibility of him overpowering someone, even with a weapon. I don't think a judge would ever compel sex. However if say services were not rendered, I could see a judge telling the the fake prostitute that she must return the money.

Think about this. Contracts, verbal and written are laid out where this is legal. And just like contracts for website development, if someone doesn't finish the job, the judge MAY order the developer to hand over whatever work is already completed. But for the ultimate solution for any contract that is not carried out is return the money, be it partial for a partially completed contract or in full where no services were provided at all. Nobody is going to demand a company or contractor that has already acted in bad faith should continue said work.

Yeah, specific performance is an extraordinary remedy. It's only awarded when there is no other legal remedy available. Refunding the client's money is an available legal remedy, so I see no reason why a court should ever order specific performance of such a contract.

Note that ability to pay doesn't have to factor into the court's decision to award a monetary judgement. That becomes the problem of the person trying to collect the judgement.

What's more, if there's a serious concern that a court might order specific performance from the hooker, the lawmakers could just put in the law that specific performance is not an available remedy in contracts for sex. Courts enforce the laws, they don't write them. If it's clearly written, unambiguous, and constitutional, they're supposed to enforce it as written.
