ok gentlemen, felt bored and decided to do a little outline

so as mentioned earlier the original charge was for 25 grams or more. this was a second degree drug crime under 152.022 subdivision 2 (a)(1)
the person unlawfully possesses one or more mixtures of a total weight of 25 grams or more containing cocaine or methamphetamine
under the plea it was reduced to a third degree drug crime as shown in today's paperwork, under 152.023 subdivision 2 (a)(1)
on one or more occasions within a 90-day period the person unlawfully possesses one or more mixtures of a total weight of ten grams or more containing a narcotic drug other than heroin or fentanyl
going all the way back to when this incredibly entertaining arc began i posted the sentencing guidelines grid. let's take another look

at the time nick's criminal history score was a goose egg, column one on the first page. controlled substance crime, 2nd degree, row 3. presumptive sentence length of 48 months. the reduced charge he pled to, 3rd degree, row 4. presumptive sentence length of 21 months. gray box sentences are stayed, that is postponed execution until certain conditions are met. if the convicted meets their obligations, bam, no sentence. even says at the discretion of the court, you could get a jail cell up to the maximum (365 days or more would mean prison, not jail) and other fun stuff like picking up that guy from earlier's soupcans off the side of the road

page two we have the breakdown of how these sentences usually split between confinement and supervised release. the original charge's 48 months could typically end up being 32 months imprisonment followed by 16 months supervised release. the 21 months of the charge he pled to could've been 14 months in the slammer and 7 months pissing on command

instead we end up with, until he fucks up anyway, no actual prison time. the possibility of the shortest month of the year's length of jail time, and what seems to be a huge curveball in 60 months of probation

the kayla and april cases were dismissed as part of this as per the earlier reporting. he actually somehow did something good for other people by eating a large shit sandwich, voluntarily remaining in the system for longer than he would had he just been found guilty of the original charge. could potentially stay out of jail entirely. could be drunk right now and being put right back through the ringer come monday morning, actually buying himself a oneway ticket to the rapehouse. to him, his wife, his sidepiece, this is a win over what could have been. i'd prefer this outcome for myself if i were also a retarded coke addict. but what should have been was him actually being a good father

Looking forward to his AIDS arc when he's released.

People thinking this is lenient need to remember he will be turned inside out by the prison population. They don't look favourably on crimes related to children.

This place doesn't even look that bad by american standards, its in some bumfuck county and probably not for the hardest of offenders. There's still that tiny amount of hope that he gets jailhouse rocked like Styx but i doubt it because Minnesota is not the blackest of states.

Sadly i didn't see any news articles about people getting shanked or brutalized by guards etc so it might be semi peaceful 28 days, i dont think Rackets will step up to anybody when sober and suffering withdrawals from his addictions.

lets say rekieta can't stay sober until august, fails the sobriety tests and goes to county jail for 30 days. does that mean rekieta still needs to be drug and alcohol free for 5 years?

because, in his swiss cheese brain, i can see him subconsciously take the 30 days in jail than take 5 years of sobriety.

He’s got a mouth on him and has an anorexic body. If I were his bunkie I’d beat his ass. And no I’ve never been to jail so I assumingly am a better class of human than the average lot in Candyho County - not a high boast by any means.

because, in his swiss cheese brain, i can see him subconsciously take the 30 days in jail than take 5 years of sobriety.
His felony charge is stayed and requires completion of the probation.
He has to complete the full 5 years without major fuck-ups and show a good faith attempt to actively participate and better himself.

The 30 days in jail are currently on the schedule for August 1st and they may be deferred by probation if they see him making that good faith attempt.

This is not so much a possible punishment for when he fucks up.
This is a scheduled punishment for not making an effort yet. The PSI was clearly devastating and the PO likely reported that Nick was not making an effort, refuses to cooperate properly and that there is little chance that Nick will change his ways in the immediate future without proper motivation.

That motivation to get his shit together is the 30 days in jail, which he WILL have to show up for unless his PO says "ok, he is finally working on it properly".

Do not let the Skelly freak and his fanbois turn this around. Nick not going to jail is dependent on his PO signing off on it.
 
He's going to go to jail one way or another.
Nick has a better chance of winning the powerball than he does of staying sober for 5 years.
That shit is absolutely not happening.
Don't know how long it'll be. It's possible he could get close to a year clean maybe, who knows.
but five years? no fucking way.

I mean really it would probably be better for him if he just asked the judge to put him in jail now.
Maybe he serves like 6 months with good behavior or something and just gets it over with.

Having to be on probation for 5 years is fucking brutal.

ok. the 30 days is part of the sentencing (deferred if his probation officers signs off), along with 5 years sobriety. so, it is not an "either or" situation. i understand that now.

but what are the consequences for rekieta if he can't do 5 years of sobriety? additional jail time, heavy fine, or just have this on his permanent record?

Yes I’m a little confused too.
Supposing the sentencing did not mention 30 days, and was just “5 years probation”.
Would that still mean he would go to prison at any time during the 5 years if he fucks up?
I thought that’s what probation meant.
