Here are the Minnesota charges

609.195 MURDER IN THE THIRD DEGREE.

609.205 MANSLAUGHTER IN THE SECOND DEGREE.

609.19 MURDER IN THE SECOND DEGREE.

I have highlighted what I believe are the relevant sections of each charge. Corrections welcome.

The first two charges are dead if the defense brings forth the knee hold being a standard part of police training. You are not going to get jurors to convict a police officer for "an act eminently dangerous to others and evincing a depraved mind" or "person creates an unreasonable risk" when it is what they have been trained to do.

And the third charge makes even less sense since the autopsy shows no life injuries to Floyd beyond what you would expect from a simple scuffle with police. I don't see how a conviction is possible on this charge. This charge would make sense if Floyd was struck repeatedly with a baton and then died later from those injuries.

Edit:

The most important thing to take away from this text is:

  1. The text for each charge is specific to Minnesota
  2. Manslaughter is not just a lesser form of Murder - the requirements for the three charges are difference in kind - not degree
  3. Jurors take their jobs seriously and are going to be using these three sets of charging text meticulously as to whether the facts presented by the prosecution are sufficient to bring back a guilty verdict in any one of them.
They really should have gone for criminal negligence instead of shooting for the moon.

Derek is already presumed guilty by the court of popular opinions either due to fear from antifa/blm burning down the cities nationwide again or morons believing what ever the media tells you. There ain't enough woke conservatives to redpill the normies while they conspiracy theory there way to obsurdity. In summary dude is fucked and America will burn again while BLM gets away with it again fucking thanks cops for not disobeying orders to stand down and just going in ending them with full riot gear like the scum they are and just executing the traitorous politicians that let this happen. God America is truly fucked if there are more angry Americans that watch there country burn with the culprits getting away with it over and over again while one minor riot on the capital results in mass arrests and further violations of Americans freedoms.

I think he'll be convicted of something short of murder and despite whatever maxed-out sentence he gets for that pending appeal, the apes will still burn down Minneapolis again.

Yep and they will get away with it because of the police being stoped by currupt leaders. Will be funny to watch if the right riots again and how they will get prosecuted instead of blm

Point blank... no. If you genuinely believe this, every other opinion you have is questionable at best.
I could relate detailed case studies...
Seeing people downvote you for giving a detailed and correct answer, because it wasn't what they wanted to hear, is disappointing, but unfortunately not surprising.

"If you can speak, you can breathe" has been known to be false among law enforcers for a good long while now. Here's an /r/ProtectAndServe post written by an LEO *from 2014* about it:

"If you can speak, you can breathe" is bullshit. The people in this thread claiming it isn't are tards. The guys giving you thumbs down/disagree reacts are tards. There are a lot of delusional tards in this thread it seems.

To be honest the trail matters very little the guilty verdict has already been cemented in the minds of the masses. Win or lose there's going to be a nation wide bonfire. The only doubt I have is what president Harris is going to do then the festivities commence
Well, one hopes she does what she has done her entire career, and sends a lot of black people to prison. Send those rainbows my way motherfuckers.

This a hive mind of individuals who think "lol gaze are all pedos and degens" so obviously there's going to be bootlickers and christcucks.
There's a tat for every tit.

That's the thing about positional asphyxia - it happens. It's not super common but it happens, especially when an officer is leaning on the back of a suspect. You claimed it was the shoulder, then the neck. Which one is it? Because all three of those can lead into that. Again, read my link you autist, it explains the factors that lead into positional asphyxia, Floyd had all of those factors and then some. The restraint position, the health conditions, the drugs, his weight, all of it.

The officer has two legs. One was on his left arm then other on his neck. Did you even watch the fucking video?

He calls me autist but doesn't understand that the world isn't either/or. I'm not claiming positional asphyxia isn't a thing. Hell, some people will literally die if they take one aspirin. However, without carotid artery pressure or chest compression, it's extremely unlikely to almost zero for someone to lose consciousness. Otherwise we'd see stacks of bodies daily from an extremely common technique of restraint.

Given he just overdosed on meth and fentanyl around 10-15 minutes before unconsciousness, AND he was complaining of not being able to breath prior to any restraint, my magic 8-ball points to "Bix Nood Fenty shiiiiieet"

There were also two independent autopsies done that showed Floyd died of asphyxiation, not an overdose. Funny how people are ignoring that.
There was one independent autopsy, by Hennepin County, and one incomplete, non-legal, partisan autopsy paid for by people who wanted a finding of homicide to clear the way for a lawsuit. The second autopsy’s results have no legal standing- Floyd’s tissues would have been damaged by the initial autopsy (autopsy artefacts), Baden had no access to toxicology, and it wasn‘t ‘medico-legal’ (ie, any finding of homicide is opinion only, as only authorised FP’s can legally declare cause of death).
I read Baden’s book ‘Unnatural Death’ as a teenager and it set me on my career path. I had considerable respect for the man which I have now lost, as he has decided to make a living as an opinion-for-hire. A sad fall for a man whose insistence on truth once severely impacted his career when he wouldn’t change inconvenient autopsy results to benefit the city of New York.

Maybe i'm late to the party but did they ever show the bodycam footage?
The CCTV footage that was presented was hazy and didnt show alot of details

I re-rewatched the full footage after watching the defense's opening statement today. When the officers finally get Floyd over to the squad car, before they even open the door, he starts screeching that he's claustrophobic. When they finally manage to get him in the car (for like, 15 seconds), he immediately starts screaming "I can't breathe" over and over while also making these weird, feminine-like horrified screams.

The man who was the passenger in Floyd's borrowed car did everything while interacting with the police that Floyd should have. It's pathetic that I have to be impressed when a black man acts civil and obeys the cop's demands.

From my understand they took him at the word that he didn't know it was the cops. Which is why he wasn't charged for shooting the cop. It is possible both sides were legally valid in their actions.
Even under Castle Doctrine there is no justification for opening fire on someone, sight unseen, who doesn’t represent an immediate threat.
I’ve read that part of the shooter’s concern was that black drug dealers will often misrepresent themselves as cops when attacking other drug dealers’ premises in order to gain a tactical advantage.
However, it should be noted that people uninvolved in the drug trade are highly unlikely to have this happen, and even less likely to respond to ‘knock knock, open up, it’s the police’ by shooting through a closed door.
The final thing to point out is that when cops are expecting a shooting response, they don’t stand in front of the door they’re knocking on, to avoid these exact kinds of shootings.
All these things seem to me to point towards Breonna Taylor’s boyfriend being involved in the drug trade. I just wish it had been him that caught one in the bob, not her, if only to save us human beings from months of chimp tantrums.
