The ESA is a US only trade association. There are currently no international agreements concerning DP between the US and GDPR countries in the EU, so there's really no avenue to sue them for that. In the best case, they can be sued in absentia and then blocked on the eurowebs, but otherwise there's not much eurocourts can do.

Depends on whether they ever want to do business there, though. It's not like something like that goes away, even though as a practical matter a smaller organization could probably simply ignore it.

Also there are probably causes of action right here in the U.S. if you wanted to sue them here.

Each Euro country has its own version of the ESA, so it's highly unlikely they'd ever want to do business there. You are right that they could probably nail them here in the US for something (who knows how many contracts with privacy clauses were signed in the course of gathering this information), but a eurosuit invoking the GDPR is pretty much a non-starter.

After that shit the Internet storm was fucking over, everything else was piggybacked off of shit AJAX Web 2.0 sites like Facebook and Youtube. Remember HTML 5? Yeah, neither does anyone else. I'm willing to bet no one at Google understands precisely how their fucking search engine works because of all the legacy code. The fucks who commit to Android CONSTANTLY fuck it up worse than the previous version. Once you see the Computer Scientists and Computer Engineers leave (or get fired for wrongthink) a tech company, it's going to go to shit pretty fucking fast. Look at Intel as of now, they lost some good damn talent to AMD and now they're feeling the heat. All for this new-age horseshit of treating someone differently for what genes they posses.
